“Justice?” Bodnar is silent after the computer scientist has revealed the anticipation of interfering in the strategy of "slotting judges"

The Random Assignment strategy (SLPS) was to be a tool to guarantee impartiality and random allocation of judges to court cases. However, according to Tomasz Zieliński, experienced computer science, this strategy is not only full of errors, but besides susceptible to manipulation. SLPS strategy – doubtful randomness?

SLPS was implemented in the Polish general courts in 2018 during the time of the Minister of Justice Zbigniew Ziobry. Its task was to destruct the anticipation of influencing the decision on who should lead the case, which was previously the work of the Presidents of the courts or the Chairs of the departments. Unfortunately, there is no deficiency of evidence that the strategy does not fulfil its task. An example? Tomasz Zieliński, a computer scientist with more than 20 years of experience, decided to take a closer look at the SLPS action. He obtained 10 million PDF files from the Ministry of Justice with archival draw reports and wrote a program processing these data. As part of the SLPS Monitor project, available at www.slps.pl, he analysed the burden indicators of judges to comply with the Rules of Procedure of the Courts. As Zieliński himself admitted, the intent of his actions was to guarantee that no 1 manipulates the results of the judges' draws.

Manipulation and access lock

Despite many analyses, further improvement of the SLPS Monitor task was blocked. erstwhile Zieliński asked for fresh reports, he met with the Ministry of Justice's refusal. alternatively of gaining full access to the data, he was forced to manually download files – which is impossible, given that their number reaches up to tens of thousands a day. In response, in a message posted on the X platform (formerly Twitter), Zieliński announced his resignation from further improvement of his project.

"I was deprived of the chance to add fresh data to the SLPS Monitor project" wrote Zieliński, pointing to the decision of justice Dominik Czeszkiewicz and the silence of Minister Adam Bodnar as the main reasons for blocking his actions. Zieliński pointed out that many judges utilized the SLPS Monitor to check the number of cases their colleagues from another departments received.

Adam Bodnar's silence

In the past, Adam Bodnar, as Ombudsman, expressed doubts about the operation of SLPS. He stressed that the deficiency of transparency of the origin code of the draw algorithm prevented a full assessment of the system's impartiality. In 1 of his 2022 speeches, he wrote:

"The deficiency of a origin code does not find how judges are selected for circumstantial cases, and in practice it turns out that the consequence of the draw raises doubts for citizens who rise a number of objections in the content of the requests to the Ombudsman."

Despite erstwhile declarations, after taking the position of Minister of Justice, Bodnar stopped taking action to audit the system. The organization Watchdog Poland, which fights for the transparency of the origin code of SLPS, lost the case before the Provincial Administrative Court, although inactive waiting for the justification of the judgement to be able to appeal.

Simon Ossowski of the Citizens' Network Watchdog Poland does not hide outrage: “The silence of Adam Bodnar is simply a scandal.”

Conclusions of Zieliński: the strategy is flawed

Zieliński, based on the analysis of the data, stated that SLPS is simply a centralised system, operating in a completely opaque and unauditable way. According to him, SLPS supporters can freely change the judges' burden rates and another strategy parameters, resulting in the manipulation of the draw results. This means that, in the current plan of the system, we cannot talk about the full random allocation of cases to judges.

SLPS secrets – what next?

Since the introduction of the SLPS, socialists have been trying to find out if the strategy actually works according to assumptions. Although in 2021 the ultimate Administrative Court managed to win the transparency of the warehouse allocation algorithm, there is inactive no access to the origin code. Without this it is hard to measure how the strategy works and whether it is actually free from manipulation.

The situation where audit activities are blocked and the SLPS origin code remains secret raises serious doubts about the transparency of the system. Socialists and lawyers, specified as Tomasz Zieliński and Watchdog Polska, are inactive fighting for transparency and the ability to verify whether the strategy of drawing judges works legally. Will their actions produce the expected results? Time will tell.
