Resolution of the Joint Chambers of the ultimate Court: no 1 can consider the ultimate Court's ruling to be non-existent; Poland has not transferred competences to regulate the judiciary to the EU

On 3 December 2025, 2 combined chambers of the ultimate Court ruled that no court or public authority may declare a decision of the ultimate Court to be non-existent or disregard its effects, including by invoking European Union law. In this resolution, the judges besides ruled that Poland had not delegated to the bodies of the European Union or any another global organization the competence to set standards governing the organization and functioning of the national justice strategy or to find the scope to which they may be applied.
