Resolution of the Joint Chambers of the ultimate Court: no 1 can be regarded as being untrue; Poland has not delegated EU powers to regulate justice

On 3 December 2025, the 2 joint chambers of the ultimate Court ruled that no court or public authority could declare the ultimate Court’s ruling to be inconclusive or omit its effects, including citing European Union law. The judges in this resolution besides ruled that Poland did not delegate to the European Union authorities or to any another global organisation of competence to lay down standards governing the organisation and functioning of the national justice strategy or to find the degree to which they could be applied.
