Cenckiewicz urges Nawrocki to print an annex to the WSI report

Cenckiewicz asks Nawrocki to disclose an annex to the Military Information Services (WSI) verification report.
Cenckiewicz is besides to search lawyers who would have prepared opinions to circumvent the 2008 Constitutional Court ruling, which suspended publication of the annex.

Judgment of the Constitutional Court of 2008
In 2008, the Constitutional Court ruled that the Act allowing president Lech Kaczyński to disclose the WSI verification study is partially incompatible with the Constitution of Poland. This meant that until the bill was amended, the president could not disclose an annex to the report.

Although Law and Justice ruled for 8 years, the bill was not amended, so the ban on publication of the annex is inactive in force.

What was considered unconstitutional
The Constitutional Tribunal has identified a number of violations of civilian rights and constitutional principles, including:
• no anticipation of recourse to the court for the persons mentioned in the report,
• deficiency of access to the file of the verification committee for these persons,
• not being able to hear the individual mentioned in the study by the committee,
• no legal basis for publishing additions to the study on private individuals,
• breach of the presumption of innocence.
