Controls at the German-Polish border have been in advancement since October 2023. They are based on the Dublin III procedure. It states that in rule only 1 associate State is liable for examining a request for protection in the European Union — usually the first EU country whose border is crossed by a foreigner seeking protection. On this legal basis, foreigners are returned to the countries liable for examining their exile applications.
On Friday Prime Minister Donald Tusk said that closing the border with Germany and restoring the situation before entering the European Union is unnecessary and would hit the interests of average people. He added that he is aware that Poland has a multi-annual agreement with Germany on the alleged readmission of migrants. “Most European countries have specified agreements. But I informed the German partners that due to how many refugees we received from Ukraine and due to migration force on the east border, Poland will not accept immigrants coming from another European countries," said the head of government.
On 11 March, at the European Parliament plenary session in Strasbourg, the EC proposed fresh EU return rules. The aim is to make a common strategy for all associate States to return migrants who do not have the right to reside in the EU. The fresh regulation is intended to supplement the migration pact. According to it, asylum applications are to be dealt with faster and more effectively, but in order for the full strategy to operate smoothly, rules should besides be introduced to enable migrants to be returned erstwhile the asylum decision is refused.
Poland is 1 of the countries that did not submit their implementation plan in Brussels. The rulers have repeatedly declared that Poland does not intend to implement the provisions of the pact. In February, Prime Minister Donald Tusk at a gathering with the European Commission's Head Ursula von der Leyen said that "Poland will not implement the migration pact in a way that would origin additional, any amounts of migrants in Poland".
