Anonymous author of the petition to the Sejm calls for a change in criminal law, taxation law and social, pension and wellness insurance legislation. All to "comprehensively regulate the provision of sexual services (prostitution) and accompanying services related to human sexuality". In another words, it is about legalization and taxation of prostitution. The issue in the Sejm will be addressed by Members from the Parliamentary Committee on Petitions next Wednesday. They will consider whether to put the substance on the run or to reject the petition immediately. ‘ The issue of the approach of individual European countries to prostitution (the provision of sexual services) has late been of interest to many public institutions, but besides to a lively social debate. And rightly, due to the fact that it is an area which requires specified a discussion, the consequence of which should be to align existing legal solutions with the current, modern social and cultural framework and contemporary concepts of lawmaking," the paper states. Strong arguments The author of the petition on 10 pages tries to convince Members by presenting detailed arguments to them. The most crucial of these are: the issue of the availability of alcohol is already regulated by law – the same can be done with sexual services, the law should not be based on moral and spiritual views, and less Poles condemn prostitution, taxation of specified services will support the state budget, legalisation will increase educational opportunities and aid fight organised crime. ‘ In addition to the benefits of additional budgetary revenues, the advantage of specified a solution is that this activity will cease to function in the ‘grey area’ between the existing rules and the alleged ‘citizenship’. Public administrations will be given the chance to have real insight and supervision of what is happening in this area, both in legal and taxation matters. It will besides be easier to implement preventive measures to combat organised crime or pathology, specified as human trafficking, pedophilia or exploitation. However, there is no illusion that regulating the phenomenon of sexual services will completely destruct pathologies. However, it can reasonably be assumed that a comprehensive regulation of this issue will importantly reduce the negative social impact," concludes the petitioner. There is simply a advice from BAS: to reject the decision on the further destiny of the substance will be made by Members. However, it is known that the Bureau of Sejm Analysis considered the paper to meet the formal requirements. It besides points out that, in the light of European legislation, the thought is not doomed to failure. Polish law defines prostitution as: "the procedure of establishing hetero- or homosexual relations in the form of sexual intercourse or another sexual activity, usually with the convenience of encountering, changing partners, in rule without emotional commitment, in exchange for the property benefit or individual benefit treated as an equivalent for sexual contact."BAS explains that Poland belongs to a group of countries that do not penalize prostitution, while criminalising the benefit of 3rd parties – i.e. sexual services can only be earned by the individual who provides them. He stresses, "... that changes to the law on this issue should be preceded by a broad technological and social discussion". That is why it is recommended for the committee to reject the citizen's petition. Read also:
