However, many further provisions rise doubts about their applicable functioning and make legal controversy. The bill requires further work and consultation.
The Confederation of Leviathan prepared a position for the draft PIP Act in a version addressed to the Standing Committee of the Council of Ministers.
– The proposed amendments to appeal proceedings before courts only seem to affect the predictability of the fresh rules and do not velocity up the actual handling of cases. On the contrary, many solutions show that the designers themselves do not believe in fast and unambiguous settlement of disputes over the nature of contracts. This concerns, for example, a very controversial safety provided by courts," says Robert Lisicki, manager of the Labour Department of the Confederation of Leviathan.
The Confederation of Leviathan stresses that during the erstwhile consultation it repeatedly requested clarifications on the taxation implications of retraining of economical operators. However, specified information has not yet been provided.
– The planned changes require provisions to guarantee greater predictability of control activities for entrepreneurs conducted by PIP, especially as companies are besides subject to controls by another institutions. We are besides proposing to regulate the maximum duration of PIP control," adds Robert Lisicki.
The Confederation of Leviathan besides states that if work on the bill continues, the fresh provisions should enter into force at the earliest from 1 January 2027. It besides expresses its readiness to proceed dialog with public administration to make solutions that will advance the stableness of law, the safety of economical trade and the protection of the labour market.
According to a fresh January survey conducted by the CBM Indicator commissioned by the Confederation of Leviathan, 58% of entrepreneurs do not support the improvement of the State Labour Inspection and the strengthening of the powers of inspectors. This opinion is shared by entrepreneurs regardless of the size of the company.
