– The Sejm elected six judges of the Constitutional Court, but only 2 have made a vow so far.
“I am very critical of president Karol Nawrocki’s attitude. He allowed only 2 legally elected judges to take their vows. It is not known what the decision will be about the another four. I am not convinced by the arguments put forward by the Chancellery of the president and the Law Office, and there were many of them. Procedural violations were sought in the Sejm, it was alleged that no cast was made on time, but that does not in any case alter the fact that the president must let a vow to be made and these judges should start working in the Constitutional Court.
– The president's breaking the law?
I think so. Although the Constitution does not say anything about a vow, it states that the Judges of the Court elect the Sejm. The Act on the position of Constitutional Court Judges only grants the president the function of the individual to whom the oath is made. Therefore, it should not prevent the elected judges from taking the decision from taking the oath without delay. It's his duty. If the president cites any unforeseen reasons to postpone the date of the vows, I believe that he is besides violating the constitution.
