Judges, prosecutors and advocates from associations: Judges for the Republic of Poland, Lawyers for Poland and the Association of Prosecutors Ad Vocem made an appeal at president Andrzej Duda's office to take action in connection with the notorious violation of the law by the Minister of Justice in the government of Donald Tusk, Ukrainian Adam Bodnar.
Lawyers are tired of Bodnar and his demolition of justice in Poland. 5 May this year 3 nationwide legal organizations – Judges for the Republic, Lawyers for Poland and the Association of Prosecutors “Ad Vocem”, submitted in president Andrzej Duda's Chancellery a letter in which they request his appeal.
The appeal pointed to a number of actions by the minister to violate constitutional principles of the state's system. Bodnar was accused, among another things, of illegally preventing Darius Barski from acting as the National Prosecutor, of illegally revoking the Presidents of the Courts, of discrimination of judges appointed after 2018, and of working on the law "to reconstruct constitutional governance in the judiciary", which is intended to undermine the rule of the insolvency of judges and the constitutional prerogative of the President.
The authors of the letter state: "Since 13 December 2023, the Minister of Justice and his colleagues have committed a manifest and gross violation of the law, the most striking examples of which are: unlawful disqualification from acting as Prosecutor of the National Prosecutor Darius Barski, dismissal of the Presidents of the courts in violation of the law, discrimination against judges appointed by the president after 2018 by preventing them from ruling on matters applicable to the executive authority".
The charges besides included the dismissal of justice Piotr Schab as Disciplinary Ombudsman of the General Court Judges and justice Przemysław Radzik as his deputy. According to the legal community, these decisions had no legal basis and violated the independency of the advocacy functions, which, as indicated by the Act, have a four-year word and are not subject to prior appeal.
During the press conference before the Chancellery of the president of Poland, representatives of associations expressed their position. – As Lawyers for Poland, we have prepared 3 reports on the violation of the regulation of law in Poland, which takes place under the aegis of the lawyer General. (...) Poland, the centre of Europe, with specified a beautiful, long-lasting history, appears to be any banana republic where the constitution is not respected, does not comply with the laws, does not take into account global obligations, so we say, ‘enough’. – said Dr. Łukasz Piebiak, president of the Association of Lawyers for Poland.
