"By acting as the Foundation of Life and household (hereinafter besides as the Foundation), we ask again (following the first letter dated 27 June 2023) to immediately let the representatives of the Foundation to make guidelines for medical entities regarding termination procedures (hereinafter referred to as the team) together with access to the full documentation developed by the team.

We point again to the basis for allowing the squad to work, i.e. § 2(3) of the Ordinance of the Minister of wellness of 12 June 2023 on the establishment of a squad for the improvement of guidelines for medical entities in the field of procedures related to termination of pregnancy. First of all, we are besides referring to the arguments put forward in advance to present the current argument in favour of the legitimacy and, in fact, the necessity of this proposal.

We stress that the members of the squad met with representatives of left-wing groups (with left-wing MPs) and pro-abortion activists. The incidental of 29 August 2023, widely described by the nationwide media, during which the MP at the Polish Sejm Grzegorz Braun and supporting him in the intervention of the individual (including the following) did not receive the requested information about the work of the team, and 3 police units led defenceless women from public buildings (held by taxpayers), i.e. the Ministry of wellness building. These methods remind us of the darkest moments of Polish past in terms of censorship, deficiency of respect for citizens and the brazenness of power. This case is presently under investigation and the Foundation will inform the public. It is worth recalling again that the squad met with representatives of leftist views, while armed police forces were sent to defend the lives of unborn people.

The rule of transparency in the sphere of public administration activity, as well as the transparency of information on the functioning of the state and the public officials representing them, are among the fundamental criteria for the improvement of any democratic regulation of law. According to the assumptions of Article 4 of the Constitution of the Republic of Poland of 2 April 1997: “The authority of the superior in the Republic of Poland belongs to the Nation, which holds it by its representatives or directly”. This provision clearly stresses the crucial function played by sovereigns. The sovereignty of the Nation so continues all the time and does not exhaust itself entirely in a democratic electoral act, which could be derived from a possible evidence of the origin of power from the Nation. This clearly argues for the request for citizens to participate in the creation of social control in the performance of public tasks by a state apparatus.
