The European Court of Human Rights in Strasbourg ruled that Poland, erstwhile refusing to execution a child, with whom Down's squad was found, violated Article 8 of the European Convention on Human Rights. Poland must pay over 15 1000 euros for refusing to carry out an abortion. Polish abortionists are involved.

In 2021, FEDERA's pro-abortion lawyers brought to the European Court of Human Rights the case of a 38-year-old female who was denied abortion. They formulated an accusation against Poland for canceling the murderous procedure on her 14-week-old kid planned for 28 January 2021 in 1 of Warsaw hospitals. The refusal to carry out abortion was linked to the publication of the Constitutional Court's judgement in the authoritative diary of the Law and the judgement entered into force. It happened on January 27 after 11:00. The ECHR stated that "there was a violation of the right to respect for private and household life", but did not announcement that on the day on which the abortion of the sick kid was to take place, the legal protection of children with Down syndrome was already in force in Poland.

Eventually, the kid was murdered in the Netherlands on 29 January 2021. Abortion lobbys utilizing the situation organized a case against Poland, and now wants to usage it to dismantle life protection and legalize abortion.

The ECHR even tempted to review the actions of the Polish Constitutional Court and to formulate an opinion that the judgement of the Constitutional Tribunal on the eugenic grounds was not correctly established. The Court of Strasbourg besides referred to the protection of private and household life in order to justify the desire to execution a kid – what effects it may have in the future, it is not hard to imagine: criminals specified as Madzi's parent or Kamilka's stepfather can besides claim that they enjoy the right to decide their household life. It's just that their kids were a small older...

It should be recalled that the European Court of Human Rights is tasked with verifying the application of the law in force in the country concerned. It is so not the function of a Strasbourg tribunal to order or push for changes in regulations. It is besides not his function to examine the legislative process which has resulted in concrete legal solutions. A million Poles demanded protection from eugenic abortion. ETPC usurp itself the right to interfere in an area which it does not deserve.
