The possible mobilization of police in connection with the situation in the TK reported unofficially to Polsat News. The case is to be linked to the conflict concerning the position of the 4 judges of the Court and the decisions of the president of the Constitutional Tribunal Bogdan Święczkowski, which has been ongoing for respective months, which prevents them from taking part in the ruling.
The Minister of Energy Miłosz Motyka referred to these reports in Friday's programme "Graphiti". He admitted that he had no cognition of the exact reasons for police action and did not want to make his own assumptions about it. At the same time, he pointed out that possible acts of the officers should be justified accordingly. Among the possible reasons, however, he pointed out the safety of certain documents, stressing that this was only an unofficial information.
Maciej Berek spoke
Maciej Berek, erstwhile minister and close associate of Prime Minister Donald Tusk, who was late elected justice of the TK, besides referred to the situation in the Court. In his opinion, Bogdan Świętczkowski should not presently direct the Constitutional Court.
This is not a question of my assessment, regarding the manipulation of the Court's compositions, we had information from the judges themselves. All judges have the same plan. It aims to make usage of the rules that apply and to address the situation explained Berek.
In his opinion, further decisions concerning Świętczkowski's function should be taken by the president of the Constitutional Tribunal himself. At the same time, Berek considers that Świętczkowski cannot effectively direct the Court due to problems related to the correct appointment of the Judges' configurations for individual cases. He besides pointed out the request to find a solution that would prevent 1 individual from blocking the enforcement of the European Court of Human Rights ruling.
Two conferences related to the situation at the Constitutional Court were scheduled for Friday. 1 of them will be held at the office of the National Judicial Council. There are 4 erstwhile CEOs to participate. TK: Andrzej Zoll, Marek Safjan, Jerzy Stępień and Bohdan Zdańicki.
AWS Conflict
In parallel, police activities are conducted at the Academy of Justice. There has been a conflict in the facility for any time about who should service as its rector.
Michał Sopiński maintains that he did not receive a decision formally informing him of the dismissal. Waldemar Żurek, acting as rector, appointed Sławomir Cudak to this position. However, this cannot enter the university, as it is to be blocked by members of the PiS club associated with the environment of Zbigniew Ziobra.
