Without a clear position
After the Tuesday meeting, the PKW has no clear position on the amount of backing that the Law and Justice should receive. According to the head of PKW, justice Sylwest Marciniak, in the absence of a resolution on 2 resolutions, funds for the Law and Justice should be paid in full.
Currently it is known that PKW adopted 2 resolutions. The study of the PiS electoral committee taken in August was rejected, resulting in a simplification in subsidies and subsidies. On the another hand, in November, a study by the organization itself was rejected, which, under the Political organization Act, means that the subsidy will be suspended for 3 years.
The Law and Justice have challenged both decisions to the ultimate Court, and in the first case the Chamber of Extraordinary Control and Public Affairs acknowledged the party's right.
On Tuesday, the PKW decided that due to the unclear position of the home of Extraordinary Control and Public Affairs of SN and the judges in it, the settlement of the case will be postponed until the constitutional authorities of the Republic of Poland regulate its legal status. On the another hand, the IKNiSP decision has inactive not been taken in relation to the second PiS complaint.
No Final Decision
There is no final decision. I hope that the Polish authorities will yet get the situation right. The current situation makes it impossible to decide on this. There are doubts as to whether the Chamber which issued the ruling is simply a court. PKW is not another court that can thus justice another court – explained Paweł Giras, 1 of the PKW members.
On the another hand, the head of PKW Sylwester Marciniak explained:
We have a situation that there is simply a resolution of the PCW on rejection, we have a complaint and even if we consider that the ruling is non-existent, we have no settled complaint. Until the complaint is dismissed, it has no legal effect.
In the remainder of his statement, Marciniak pointed out the problem with the judiciary:
A year ago, I pointed out that this wasn't just about the ultimate Court. We have 3,000 judges appointed after 2018. Hundreds and thousands of judgments fall all day, and we, as a public authority, have doubts as to whether this ruling is crucial or not.
In the end, despite the rejection of the reports, PiS continues to receive funds from the state budget, and next year subsidies may amount to up to PLN 17 million.
USA and money for the Law and Justice
The current situation in which PKW, the ultimate Court and the Ministry of Finance are active is likely to proceed to receive a organization subsidy from the state budget paid in quarterly instalments. At the end of January 2025, the organization should receive about PLN 2.1 million for the last 4th of 2024, which means that in the full 2024 it will receive a reduced subsidy of about PLN 15 million alternatively of the first PLN 26 million.
If the situation remains unchanged, in 2025 the PiS may anticipate a akin amount, divided into 4 instalments, i.e. about PLN 3.75 million per quarter.
Politician Mariusz Gosek, who is part of the Law and Justice organization in an interview with “Fakt”, points to another anticipation of gaining money. He states that he is very looking forward to the intervention of the United States in the interior situation of Poland. This would take place after January 20, which would be after Donald Trump was sworn in.
I am convinced that the United States is looking closely at this anti-democratic action in Poland, due to the fact that it is simply a threat to the safety of all Europe. I am profoundly counting on the United States – said Gosek.
