The European Parliament, in its Tuesday vote at its plenary session in Strasbourg, waived the immunity of Euro MPs PiS, Mariusz Kamiński and Maciej Wąsik. The 2 had previously criticised Adam Bodnar's request to the Europarliament on this matter.
The motions to waive the immunity of Wąsik and Kamiński were sent by the lawyer General and Justice Minister Adam Bodnar to EP head Robert Metsoli at the end of July last year. The D.A. accuses them of not complying with the final judgement of the court.
Prisons and prohibition of public office
The Polish justice strategy conducts proceedings concerning the failure of Kamiński and Wąsik to comply with the final judgement of the Warsaw territory Court of 20 December 2023, which ruled against them a five-year ban on public office and a two-year imprisonment.
"The evidence collected on the subject provided grounds for establishing that Mariusz Kamiński and Maciej Wąsik, despite the final ban on public office against them, did not comply with this prohibition and exercised the mandates of Members by taking part on 21 December 2023 in the proceedings of the Sejm of the Republic of Poland, including in the votes held by the Sejm number 141-147 and participation on 28 December 2023 in the parliamentary gathering of the Committee on Administration and Home Affairs" - the prosecutor previously submitted in a communication.
Kamiński, after proceeding the European Parliament's legal committee at the end of January - which was 1 of the stages of the EP trial - told journalists that the prosecution's motion to remove his immunity was completely unfounded and serves "only to repress (go) as a individual associated with democratic opposition" in Poland.
A akin opinion was expressed by Wąsik after his proceeding before the legal committee in February. "We held a mandate, and charging Members for voting and participating in Parliament is simply a political action," Wąsik told journalists in Brussels at the time.
Politicians Waiting for Decisions
Following a vote, the president of the European Parliament, Robert Metsol, is to forward the decision to MEPs and the competent authority of the associate State, without delay.
The European Parliament is presently besides dealing with another proposals to waive the immunity of Polish MEPs. The procedures were besides launched in the case of Michał Dworczyk, Daniel Obietek and Grzegorz Braun.
In the erstwhile EP term, he waived the immunity of 4 Polish Euro MPs - Beata Kempie, Beata Mazurek, Patryk Jak and Tomasz Poręba.
