Ordo Iuris: Frontal assault on marriage

Ladies and gentlemen,
In the autumn of last year, on the website of the Government Legislative Centre, a task was published by the Minister for Equality, Katarzyna Kotula, which gives single-sex concubines privileges reserved for marriages. The bill was to be pushed through Parliament as a government project. At 1 of LGBT marches, Minister Kotula even announced that "after partnerships, after matrimony equality, after the sex agreement bill, for dignity and human rights for the LGBT community, she would go to hell and make a pact with the devil." The devil’s followers actually marched during the last June “Parade of Equality”, carrying the banner “Satan does not exclude”.


Although it has been months since the publication of the project, the government task has been halted. An analytical effort and an information run conducted by the Ordo Iuris Institute was of large importance at the time. Ordo Iuris experts then did what they were best at – we analysed more than 500 pages (!) of documents, which are part of a package of regulations introducing "partner unions", which have been interfered together in... over 250 existing laws!

After the proposed changes came into force, Polish law would give couples marital taxation privileges or the right to collect the pension of a widow homosexual partner, let them to exercise joint care over children adopted by partners, regulate the naming of a homosexual biological partner of a parent, and even... let refugees to bring their homosexual partners to Poland, and professional soldiers to take homopartners on missions...

Although this task was frozen, it was 10 days after the second circular of elections that the Left club submitted a akin task in the Sejm as a parliamentary project. Last week the bill's consultation ended.

According to the laws proposed by the Left, same-sex relationships are to imitate constitutionally protected marriages. The "partner unions" are to be registered (similar to marriages) in civilian law offices, to jointly account for taxes, and even to participate in the care of children adopted by partners, which is simply a clear introduction to the introduction of homo adoption.

The time has come for our movement and fortitude to reject the incorrect law, to defend family, matrimony and children.

The effectiveness of our actions is confirmed by LGBT activists themselves. The global Lesbian and Gay Association (ILGA) published a study on the implementation of LGBT lobby demands in Europe. Poland took its far 39th place from 49 countries. That's not all! A study by the European Parliamentary Forum on Sexual and Reproduction Rights on "antigender" organisations in Europe has just been published. In our legal opinion to the draft Law of the Left on "partner unions", we point out that the draft agrees with the constitutional definition of matrimony understood as a relation between a female and a man, creating an institution of "partner unions" imitating marriages. The single - sex concubines would, in accordance with the proposed regulations, receive the most attractive marital privileges, but would be exempt from many obligations related to marriage. In our opinion, we reminded the rulers that the reason why marriages are equipped with Polish law with many privileges is the expected benefit for the nation in the form of conception and birth of a fresh man and citizen and raising it in the most natural, unchangeable environment of marriage, promoted by the state as a model form of life.

However, legal opinions are not everything. It will be crucial to scope out to a wide audience, to opinion leaders, to politicians and journalists, and to clergymen with accurate, honest arguments "In defence of marriage".

Predicting specified a turn of events, as of December last year, our boardmate Ordo Iuris wrote his next book under this title. In June, the study "The Independent Expert on Protection against force and Discrimination on grounds of sexual orientation and sex identity" accused Poland of discriminating homosexuals, including by denying them the right to formalise their relationships.
In our answer we pointed out that the paper was created on the basis of an unreliable, selective methodology. Its author Graeme Reid ("Independent Expert") – known for publications promoting the LGBT agenda, specified as "How to Be Real Gay. Gay identity in tiny towns of South Africa" – it was based solely on the reports collected in the largest Polish cities during talks with City Hall officials and LGBT activists.
This “Independent Expert” demands Poland to formalise monosex unions, introduce homoadopted, fight hatred speech, refund transitive mutilation of young people, and let migrants whose Lukashenko government brings to our east border.

It is besides no wonder that the “Independent Expert” study positively assessed the efforts of Donald Tusk's government, who is working intensively on implementing the sex agenda in Poland.

Our actions at the level of national lawmaking, providing arguments to matrimony defenders and fighting for a household on an global level are bearing fruit, as evidenced by, for example, cited abroad reports indicating the effectiveness of Ordo Iuris.
That's how effective it is. And the only way we can bear the cost of our activities is through the generosity of our Donors, who thus engage in a common conflict for household and marriage.
I believe that thanks to the support of people like you, we will halt the ideological revolution in our homeland, which will stay a country on defender for the defence of matrimony and family.

In the aforementioned study of the global Lesbians and Gays Association (ILGA), as 1 of the key actions allegedly affecting homophobia in Poland, LGBT activists mention the conviction by our experts of the Sejm Committee on Petitions to unanimous support in July 2024 of our draft law prohibiting the transitive mutilation of minors by giving them puberty blockers and other sex hormones and subjecting them to mutilating operations of cutting out healthy sexual organs in the name of sick ideology. Our draft for breaking the ban provides for 3 years imprisonment. With the support of the Sejm Committee on Petitions, the task was further developed in the applicable parliamentary committees – the wellness Committee and the Committee on Justice and Human Rights.

We have achieved even greater success in the case of the civilian task of the halt Drugs Pornography Act prepared by the experts of Ordo Iuris, which will defend Polish children from vulgar pornography on the Internet. The task contains a number of effectively forcing solutions on pornographic content providers to verify the age of users. We have collected more than 212 000 signatures under it and convinced the full Sejm to support it unanimously and to forward it to further work. In the EPF report, the Ordo Iuris and the Hungarian Mathias Corvinus Collegium study “Great reset: restoring the sovereignty of the associate States in the European Union”, in which we proposed a far-reaching improvement of the European Union in the spirit of strengthening the sovereignty of national states. Abortionists have besides pointed out our activities at the UN, including consistent opposition to the inclusion of abortion killing of unborn children in the human rights system.

We hope that with the support of our Donors and Friends, besides in the case of the Kotuli project, we will persuade parliamentarians to reject it.

Homo-union is contrary to Polish law
Left-wing politicians are not trying to force formalization of single-sex unions in Poland for the first time. Until now, however, their actions have failed. Among another things, the activity of Ordo Iuris experts, who repeatedly recalled that, in accordance with Article 18 of the Polish Constitution, "marriage as a union between a female and a man, family, motherhood and parenthood are under the protection and care of the Republic of Poland" and therefore, any effort to introduce formalization of single-sex unions in Poland will be contrary to applicable law.

In 2016, erstwhile the PO MPs tabled a draft law "on the partnership agreement", we stressed that, in addition to the apparent contradiction with the law, the paper besides contains many violations of the principles of legislative technology. On the another hand, erstwhile LGBT activists requested the Constitutional Court to declare the provisions of the household and Care Code incompatible with the Constitution of the Republic of Poland, which warrant the right to marry only a female and a man, we submitted the opinion of the ‘friend of the court’ to the judges of the Constitutional Tribunal, in which we stressed that there were no legal grounds for stating that the Constitution of the Republic of Poland considers the relation of single-sex couples as marriage. Our actions led to the Court's judges dropping the claims of radicals.

On the another hand, as shortly as politicians of the present government coalition began announcing a fresh effort to attack the constitutional definition of marriage, we published a legal comment explaining why the initiative of Katarzyna Kotuli is contrary to Polish law. We have shown that Polish government provides for the protection and facilities of matrimony that are not available to couples who do not want or cannot enter into marriage. At the same time, we recalled that during Donald Tusk's first rule, in 2011, the Council of Ministers had negatively assessed the draft regulation by the European Commission on "partner unions". The Council of Ministers admitted to the fact that in Poland "the only 1 recognised – and at the level of the Constitution – an institutionalized form of union between 2 people of a household nature is matrimony (understanded as a relation between a female and a man).

In the autumn of the erstwhile year, erstwhile the Government's Legislative Centre website published a draft "Act on Registered Partnerships", together with a full package of amendments to another laws to adapt them to the rainbow revolution, we gave the government a legal opinion on the project, in which we cited a number of legal arguments against the project. Among another things, we reminded the people that matrimony is privileged in the Polish legal order not to warrant the right to happiness for the chosen individuals, but due to the expected benefit for the Nation in the form of birth and rearing of offspring in the most unchangeable and natural environment, which is simply a household based on the model matrimony of women and men.

Ordo Iuris in defence of marriage
Not wanting to let the left to dominate the beginning of the debate on matrimony in Poland, we are just finishing the editorial work on the book by the associate of the Board of the Ordo Iuris Institute, met. Rafał Dorosiński, “In defence of marriage”.

The publication will be addressed to those seeking rational reasoning in the public debate, to parents, teachers, opinion leaders and politicians who are at the heart of children, household and the future of society.

International institutions require Poland to formalise homo-union
Knowing that Poles are hard on the side of the family, sex activists want to force Poland to formalise the unions of the same sex through force from global institutions. To this end, they complain to the European Court of Human Rights, demanding its judges to recognise that the deficiency of formalisation of monosexual unions in Poland violates the European Convention on Human Rights.

Unfortunately, the European Court of Human Rights has already ruled in 4 cases that Poland has an work to supply single-sex couples with the anticipation of formalising the concubinet, despite the fact that the European Convention on Human Rights does not mention monosexual unions in any place. At the same time, we stressed that under binding global law, associate States should be free to decide how to regulate the position of single-sex concubines, and the Court should not impose solutions in this area. Unfortunately, the Court did not take our arguments into account, yielding to force from the left.

The implementation of the ECHR judgement would be incompatible with the Constitution of the Republic of Poland, which states that matrimony is understood solely as a union between a female and a man. This fact is ignored by the rulings by imposing a law whereby ‘public authorities — executive, legislative and judicial authorities (...) are obliged to implement the Court’s rulings without delay’. Its adoption will give absolute precedence to highly controversial ECHR rulings. In consequence to this, we have presented to the Ministry of abroad Affairs a legal opinion in which we discuss concrete examples of countries which, due to their national interest, refuse to comply with certain judgments of the Court of Justice in Strasbourg.

We besides responded to the message of the Advocate General of the Court of Justice of the European Union, Jean Richard de la Tour, who claimed that Poland was obliged to make a transcription of the "marriage" of the single-sex couple in Germany. We have published a legal comment on this subject, indicating that the opinion of the European Court of Justice is not equivalent to that of the Court of Justice. However, the activities of the Advocate General of the Court of Justice may be an unwarranted effort to influence the Court’s ruling, which would be an act of usurpation of power.

Together we will defend matrimony and family!
Marriage is simply a relation between a female and a man. This simple fact underlying not only a healthy Polish family, but besides the full Christian civilization, effort to deceive the genderists.

If their actions aimed at social order accomplish results in Poland, our country will never be the same again. Open to life, affirming the Christian heritage of the Homeland, it will go back into the past, becoming a vague memory. It will be replaced by a reality dominated by vulgar LGBT marches, where sex activists who rise the slogans “your children will be like us”, march side by side with Satanists. We cannot let this dark imagination to come true.

The future of our Homeland depends on the silent majority of Poles who have a choice – either to watch the LGBT lobby carry out a destructive moral revolution, or to organize and effectively defy it. Ordo Iuris, thanks to the aid of our Donors and Friends, is simply a strong centre of opposition in defence of matrimony and family.

Monitoring the work of the government and parliament on changes in law on matrimony and household requires the constant engagement of our analysts, who check whether there are proposals imposed on Poles by LGBT lobby. The monthly cost of this activity is PLN 6,000.

In turn, the preparation of any legal analysis on this complex issue is – depending on the degree of the proposed legal changes, their area and scope – each expenditure not little than PLN 10,000. Only in this way can we truly influence the form of public debate and the law in force in Poland.

The development, composition and promotion of a book on marriage, in which we break the false communicative of the left, which tries to impose on Poland the formalization of monosexual unions, is the cost of PLN 25,000. Giving this groundbreaking work during the large debate on homo-union can be a groundbreaking argument in defence of matrimony as a union between a female and a man.

P.S. Let's not fool ourselves – the LGBT lobby is not about the mythological anticipation of visiting hospitals. Left-wing activists, politicians, and the media are consciously heading towards the demolition of matrimony and the legalization of homoadoption. We can't let that happen. We must defend the right of all Polish children to be raised in average families based on marriage.
