Since 1 March. This year, by amending the civilian Code, the parties will be required to mediate in economical disputes related to the construction process. “In many types of cases, mediation is effective and helps resolve the conflict more quickly,” says Łukasz Chacia, managing partner of Karaś Chacia and Partners. Can mandatory mediation effectively reduce the number of litigation and strengthen the position of weaker marketplace participants?
