The Ordinance of the Minister of National Defence on the determination of military service capacity and procedures of military medical committees was published in the authoritative diary of the Laws of the Republic of Poland on 28 March and entered into force on 29 March.
The fresh rules set out:
- List of diseases and disabilities to be taken into account erstwhile assessing military service capabilities both domestically and abroad.
- List of diseases and disabilities taken into account erstwhile assessing the ability to service in different types of troops, in different positions and functions requiring peculiar wellness predispositions.
- List of diseases and handicaps taken into account erstwhile assessing the limited capacity to carry out professional military service in various types of Armed Forces and in circumstantial service posts, together with the category of capacity to do so.
- Scope of studies carried out in the assessment of capabilities for various types of military service.
- Conditions under which military medical commissions regulation on military service capacity.
- Specific conditions for the assessment of military capabilities outside the state.
- Procedures for the conduct of military medical committees, including the way in which the draft judgement is opposed.
- Methods for establishing the link between diseases and death with military service.
- Procedures for ruling on the request to give a soldier medical leave.
Lega artis AppThe fresh regulation results from changes in the legislative delegation introduced by amending the Act of 17 August 2023 on the Military Property Agency and another laws. These amendments besides included the procedure for objecting to the draft medical commission’s decision.
The Annexes to the Regulation contain proposals for amendments to the lists of diseases and handicaps, which aim at defining precisely the criteria for the qualification for military service and the impact of the diseases on its ability to do so. These changes are the consequence of advances in diagnostic technologies, medical improvement and changes in treatment methods.
The main objectives of the fresh provisions are to establish procedures for the operation of military medical committees, to introduce certified electronic signatures for those who follow these committees and to improve the effectiveness of the military-medical jurisprudence strategy by assessing selected diseases and disabilities and precise description of illness units.
