The full ban on the sale of alcohol would cover gas stations and spas, and its acquisition online would be possible only with individual reception in the store - the Ministry of wellness proposes. The same solutions had previously been advocated by the Left, which had already submitted a task in the Sejm, including a night Prohibition throughout the country.

Members proposed among others: a complete ban on advertising and promotion of all alcoholic beverages, including beer; a ban on the sale of alcohol at fuel stations, in medicinal establishments; and at night throughout the country 22-6 a.m. (with the anticipation of extending this time by the municipality at 21-9 p.m.); introduction of the age verification work on purchase; prohibition of selling alcohol below the sum of excise work and VAT; regulation of online sales only with individual receipt after presentation of the identity card.

Many of these solutions were previously included in the comments submitted to the government draft law of March. The wellness hotel included them in a fresh version of the proposal for consultation. In the explanatory memorandum, the Ministry stressed that the planet wellness Organisation believes that the regulation of physical availability of alcohol is one of the most effective actions to reduce its consumption.

A comparison of the 24-hour operation of fuel stations with the primary function of these places, namely the supply of fuel vehicles, clearly indicates that the anticipation of buying alcoholic beverages in them is not beneficial for public health and can lead to risky acquisition and consumption" - stressed the ministry in the justification.

If the ban entered into force, Poland would join a twelve European countries with a ban or regulation on trade in these entities, i.e.: Cyprus, France, Iceland, Ireland, Italy, Lithuania, Malta, the Netherlands, Norway, Portugal, Sweden, Macedonia and Turkey.

Since the sale of alcohol takes place on the basis of self-governments for a limited period of time concessions, the MZ proposes that authorisations for petrol stations issued before the date of entry into force of the proposed law should stay valid for the period for which they were issued, but no longer than 5 years from the date of application of the law.

New is the proposal to ban the sale on "terrestrial establishments of medicinal agents and in the premises of another facilities where wellness benefits are provided". This means that the ban will include spas.

"Until now, additional protection in the form of prohibitions imposed by the municipalities through resolutions, which, if passed, are insufficient in relation to circumstantial facilities, e.g. hospital, with the omission of another medical facilities, and are of a discretion. It should be stressed that spas are the place of provision of healthcare services and should advance a healthy lifestyle" - is simply a passage of justification.

The Ministry of wellness besides tends to have the same solution as in the draft of the Left Members concerning online alcohol trade. Its sale is to be possible only at the point of sale alcoholic beverages, including those run by another entrepreneur. The hotel tried to make this evidence already during the work on the first version of the amendment, but then withdrew from it.
