Poles face a revolution that can forever change the principles of building houses on their own plots. Municipal offices break in the seams of applications for building conditions and in any places their number increased twice or even a 100 times compared to erstwhile years. The reason is one: an impending deadline after which the construction of the dream home may simply become impossible. If you have a game and construction plans, you request to decision fast. Experts warn: these are the last months to safe their right to build on favorable, existing rules. A revolution in spatial planning is coming: What's changing?

Currently, if you do not have a local spatial planning plan for your plot, you can apply for the alleged "twilight" – the decision on the building conditions. It's a gate that allows you to build a house, even if the municipality has no detailed plans for the area. The key is that the decision made on the basis of the erstwhile rules was unlimitedwhich gave certainty to investments for years. Unfortunately, this era is coming to an end. To June 30, 2026 all municipalities in Poland must pass fresh papers – general plans. They will decide where they can build and where they can't. After that date, the anticipation of obtaining the building conditions will be severely limited, only to areas designated in the general plan as ‘building replenishment areas’.

Moreover, even if you apply before that date, there is simply a catch. Building conditions decisions which will not be valid until the end of 2025, will only have a five-year validity alternatively of an indefinite one. Grzegorz Kmiecik, Deputy Head of the Faculty of Urban Planning and Urban Planning at the Municipal Office in Łask, in an interview with the portal Law.pl, confirms that local governments must do twice as much work at the same time. Officials under pressure: 500 gold penalties for each day of delay

The deadlines for the decision are very short: 21 days for single-family houses up to 70 sqm and 90 days for another investments. The situation is besides complicated by the deficiency of qualified specialists. Grzegorz Kmiecik points out that the rates for the preparation of 1 decision by external experts are already reaching 500 PLNAnd in large cities, they're definitely even higher. A year ago, it was unimaginable. The fresh building conditions decisions, issued after 1 July 2026, will only apply for 5 years. This means that if you don't start construction at this time, you will gotta apply for a fresh decision, and it will not be so certain.

Municipalities in time trap: No general plans is chaos

The challenge facing Polish municipalities is gigantic. By the end of June 2026 they had to pass general plans, and most of them did not even begin to prepare them. The data is alarming: at the end of April 2025 none of the 2479 Polish municipalities has yet passed a general planand only a fewer twelve published his project. That means that hundreds of local governments are in deep delay. Larger and richer centres, with their own specialists and budgets, are likely to deal with this problem. If the municipality does not pass a general plan within the time limit, the fresh construction can only be planned in the areas covered by the local zoning plan. The officials who want to keep spatial order are on alert.
