Prohibiting the entry of electrical cars to subsequent parking lots gives large excitement. Restricted places not only appear in the capital. More managers decide on a akin move.
Electric cars are beginning to be treated by any parking managers as cars with LPG installation. As a result, they find themselves on the alleged blacklist. Prohibitions appear for safety reasons. Many underground garages and tunnels in Poland do not have adequate installations. Is that legal?
– The ban on parking electrical cars does not come straight from any legal provision. The rules for the usage of the private parking lot shall be shaped at the discretion of the owner or manager of the parking lot, which means that the prohibition for electrical cars may be introduced in the rules, provided that the owner or the car park manager considers it justified,” explains Katarzyna Wojtkowska-Bednarczuk, legal adviser.
It points out that in the ultimate Court case-law it was accepted that the housing community cannot adopt resolutions that go beyond the management of the common real property and interfere with the right of separate ownership of the premises.
– The owners of the premises may not, by resolution, extend the nature of the co-ownership in question, which is the basis of any housing community. For this reason, even the bans on parking of electrical cars will be controversial, introduced by resolutions of housing communities", says the patron Wojtkowska-Bednarczuk.
The problem will be getting stronger. The number of electricians is increasing. The latest statistic of the Polish alternate Fuel Association show that at the beginning of this year there were 67.1 1000 electrical vehicles registered in Poland. Only in the first 3 months of 2023 their number increased by 5.5 thousand.
According to State Fire Department data, 12 electrical car fires and 52 hybrid car fires have occurred since 2020. In 2020, PSP reported 14 hybrid car fires and 2 electrical cars. In 2021, 13 hybrid cars and 2 electrical cars caught fire, and in 2022 – 13 hybrid cars and 7 electrical ones. In 2023, 12 hybrid cars and 1 electrical car caught fire.
