§ (2) The court may besides apply an exceptional leniency in exceptional, peculiarly justified cases where even the lowest punishment foreseen for the offence would be disproportionately severe, in particular:
1) because of the perpetrator's attitude, especially erstwhile the perpetrator sought to repair or prevent the damage, or contributed to the disclosure of the crime;
(2) in relation to the perpetrator of a crime committed in association with another persons, if his function was subordinate and his unlawful advantage was minor.
Niesiołowski sold his fiancée right at the beginning of the investigation.
