The Ukrainian company BioTexCom announced the organisation of a conference in September in Warsaw promoting surrogacy, offering the anticipation to "acquire" a kid for almost 65 1000 euros. The case went to the D.A.'s office. In connection with the event, the Centre of Life and household and the Ordo Iuris Institute prepared a petition calling for blocking the event as a promotion of human trafficking, addressed to the Minister of Justice Waldemar Żurek.
The following content of the petition:
Sir,
We ask you to immediately take all steps to prevent you from organising an event in Warsaw on 12-13 September 2026, during which services of alleged replacement motherhood are to be promoted and offered. We express strong opposition to kid trafficking in the territory of the Republic of Poland and remind that the alleged replacement motherhood (surgency) is contrary to Polish and global law. Giving a kid to another individual for compensation is simply a kid trafficking regardless of how it will be named in the advertising folder. A kid is not a commodity and cannot be the subject of a price offer.
The Ukrainian BioTexCom clinic announced a conference addressed to people curious in surrogacy and insemination. The price list published by her shows that the client chooses an egg donor and a female who is about to deliver a baby. The most costly package was valued at EUR 64 900.
According to Article 619 of the Code of household and Care The parent of the kid is the female who gave birth to it. The legislator added this provision precisely to settle the doubts arising with the improvement of assisted procreation techniques. The Polish law so replied in advance: the institution of the “mother of the contracting authority” does not exist. A contract intended to lead to the issue of a kid to 3rd parties must not give emergence to an intended effect and, as contrary to the law and aimed at circumventing it, is absolutely invalid.
It should besides be indicated that according to Article 211a of the Criminal Code, the illegal organisation of the adoption of a kid in order to accomplish a property benefit is simply a criminal offence punishable by up to 5 years imprisonment.
Article 30 of the Constitution states that the natural and inalienable dignity of man is inviolable and that its respect and protection are the work of public authorities. The contract, in which the kid is given, brings man to the function of things. Article 18 of the Constitution imposes on public authorities the work of the environment to defend and care for motherhood and parenthood. The State cannot passively watch as motherhood becomes a service sold in packages.
Thus, the prohibition of surrogacy does not come from a single provision, but from the full Polish legal order — and it is simply a complete prohibition.
We decision for:
- subjecting the case to elder authoritative supervision and initiating proceedings against BioTexCom Article 211a of the Criminal Code and Article 88 Infertility Treatment Actwhich export and import of embryos across the European Union without the required authorisation provides for a punishment of up to 3 years in prison;
- take steps to prevent the event in the announced form;
- to take the initiative to amend Article 211a of the Criminal Code, so that the organisation, mediation and advertising of replacement motherhood constitutes a criminal offence, as in Italy, Germany, France and Spain.
Poland has ratified the Optional Protocol to the Convention on the Rights of the Child, which recognises as kid trafficking any transaction whereby the kid is transferred for remuneration.
We anticipate the Polish state to stand by the children.
