Deputy Minister of Justice Dariusz Myrch revealed that there was a concept of stopping work on the separation of the functions of Minister of Justice and lawyer General. The plan implies a combination of 2 laws into 1 comprehensive regulation.
Myrcha recalled during the interview on Radio Zet that in December last year the Standing Committee of the Council of Ministers adopted a task to separate these functions. At the same time, the Codification Commission of the Judiciary and Public Prosecutor's Office of the Ministry of Justice is working on a fresh Law on Public Prosecutor's Office.
New concept of merger
The Deputy Minister explained the reasons for the possible change of approach. "Somewhere there is simply a concept of not separating these 2 legal acts, due to the fact that the Act concerning the separation of the Minister (Justice) and the lawyer General does not concern just a simple provision on the separation of these 2 functions, but there is simply a full series of provisions on the functioning of the prosecutor's office, promotions of prosecutors" - said Myrcha.
He added that there was a "concept" to "yet effort to hold off on it and return to it under the fresh Law on Prosecution". As asked by PAP, he explained: "There is simply a plan to merge 2 laws - Law on the Prosecutor's Office and the current chapter (function of the Minister and lawyer General)".
Announces the Prime Minister and the Government's position
Prime Minister Donald Tusk (PO) in the June parliament exposé announced a return to projects to rebuild the "real justice system", including a task separating the MS chief from the PG function. "He should be in the interests of everyone, in full most likely the most in the interests of this empty area (it was about the seats of PiS MPs), (...), due to the fact that you have the most concerns about the activities of the prosecutor" - said the head of government.
The fresh Minister of Justice Waldemar Żurek in his conversation with "Rzeczpospolita" expressed his support for the separation of functions. According to him, the prosecutor's office, which cannot be controlled by either the lawyer General or the national prosecutor, is an institution for repair.
Historical context of functions
In times II of the Republic of Poland and in 1990-2010 and again since 2016, he has served as the lawyer General of Justice. From 2015 to 2023, Zbigniew Ziobro served this function.
The only head of the prosecution separated from the minister was Andrzej Seremet, whose word lasted from 2010 to March 2016. According to erstwhile regulations of the lawyer General, he appointed the president from among the candidates submitted by the National Judicial Council and the then National Prosecutor's Board.
