Former Prime Minister Mateusz Morawiecki (PiS) powerfully criticised the judgement of the Court of Justice of the European Union on Monday concerning the designation of same-sex marriages. He called the ruling "an insolent, shameless interference" into the legal order of the associate States. The judgement of the TEU in late November caused a sharp reaction in Poland of right-wing politicians who saw it as a threat to Polish household law.

The Court ruled that a associate State must recognise same-sex marriages legally concluded in another EU country, even if its own law does not let specified relationships. The solution concerns all EU countries, regardless of their national regulations.

Morawiecki's acute reaction

Morawiecki defined the conviction as “deep interference in the Polish household order, into Polish household law”. At the press conference, he stressed that “it must not be our agreement, and sovereignty is an absolutely essential condition for the functioning of the associate States”.

The erstwhile Prime Minister warned against the consequences of the implementation of the judgment. “If we gotta respect this judgement of the TEU, at the same time this means that a gay couple from another country will be able to exercise all rights, as if she were married in Poland”, he argued.

Morawiecki appealed: «Wara of our children, hands off Polish children». He added that «Poland cannot be a puppet in the hands of judges of the Court of Justice (EU)».

PiS MP Paweł Jabłoński cited Article 9 of the Constitution, which states that «Rzeczpospolita Polska respects its binding global law». However, he stressed that this only applies to the scope of the ratified EU treaties.

Mr Jabłoński argued that “there is not a single word in the Treaty of Functioning of the European Union that EU authorities should be given competence from associate States to form the way matrimony is to look”. PiS MP Anna April added that «for years we have been observing an effort to destruct Polish families» and recalled the constitutional definition of household as a relation between female and man.

Response of the Government of Tusk

Prime Minister Donald Tusk took a different position last week. He commissioned the head of the MFA Radosław Sikorski to prepare information on the consequences of the TEU judgment.

Tusk announced to calm the public on this delicate issue, stressing that "no 1 will impose anything on us". His reaction contrasts with the fierce criticism of the opposition.
