MOPS inactive do not know what to do. Disability did not arise in youth [Old nursing benefit PLN 2988 and PLN 3287]

For a decade, the regulations said that the nursing benefit is associated with disability created at the age of up to 18 (or up to 25 years in the case of students). At the same time, in 2014, the Constitutional Tribunal ruled that it was inconsistent with the Constitution of the Republic of Poland, but the Sejm did not implement this judgment. If the Social Welfare Centre applied the judgement of the Constitutional Tribunal, then successive governments (more precisely, voivodes) did not want to pay the Social Welfare Centre for nursing services erstwhile the disability arose, for example, in an 80-year-old man. The Minister of Finance could have clarified the dispute on this substance on 25 January 2025, but referred it to the voivode for reconsideration.
