The regulations for a decade said that care provision involves disability arising from the age of up to 18 years (or up to 25 years for students). At the same time, in 2014 the Constitutional Tribunal ruled that it was incompatible with the Constitution of the Republic of Poland, but the Sejm did not implement this judgment. If the MOPS applied a TK judgment, then subsequent governments (more precisely voivods) did not want to pay the MOPS for care services erstwhile the disability was created, for example, in the old man 80 years. The Minister of Finance may have explained the dispute on 25 January 2025, but has directed it to be reconsidered by the voivode.
