The decision of the territory Medical Court in Katowice leaves no uncertainty – doctors who took care of pregnant Isabella from Pszczyna are liable for gross negligence. The court suspended the practice of 3 doctors: 1 in 5 years, 2 in 2 years.
Thus falls the communicative of pro-abortion environments which utilized Isabella's tragedy to attack the Constitutional Court's judgement on the protection of life. Left-wing media for many months told the public that doctors were afraid to save the patient due to the law protecting unborn children. However, neither in criminal proceedings nor in the decision of the Court of First Instance appeared thesis that doctors explained their negligence by the Court's ruling.
The court found that irregularities in Isabella's care had already occurred since her admission to the hospital. Doctors ignored the basic principles of the profession and failed to exercise due care. The ruling lineup included experienced obstetric gynaecologists who clearly pointed to medical errors leading to the death of a woman.
Currently, there is besides a criminal trial against doctors in which the prosecution accused them of putting the patient in danger, and 1 of them besides for manslaughter.
The judgement of the Medical Court shows how much manipulation it was to bear work for this tragedy of regulations protecting the lives of unborn children. Protests under the slogan “Not 1 more” proved to be based on false narrative, aimed at misrepresenting Polish law as a threat to women. However, the fact is different – in this case the circumstantial doctors failed, not the applicable law. The judgement is not yet final – doctors have announced an appeal.
