Abandonment of custody

Marcin Romanowski, a politician of the Sovereign Poland, a PiS MP and erstwhile Deputy Head of the Ministry of Justice, liable for the Justice Fund, was detained on Monday after the Sejm lifted his immunity on Friday and agreed to his detention and temporary arrest.

On Tuesday afternoon, a closed detention session concerning Romanowski was held at the territory Court for Warsaw-Mokotów. The court was initially scheduled to announce its decision on Wednesday morning, but at 11:30 p.m. late in the evening an urgent sitting was scheduled. Romanowski arrived there in the convoy around 11:50 p.m.

Just before midnight, the politician's attorney, Baroness Lewandowski, informed of his dismissal. Earlier, the lawyer presented to the court an authoritative letter from the Parliamentary Assembly of the Council of Europe confirming Romanovski's immunity.

Shortly after leaving the court, Romanowski told the media:

This is an unprecedented situation. It is not about me, it is about the Polish state, which has suffered a very serious injury on the global stage, which has led to the situation of the openly unlawful detention of a associate of the Parliamentary Assembly of the Council of Europe. This is bringing Poland to the position of a third-world country by the government of Donald Tusk, by the Minister of Justice Adam Bodnar and all those who participated in this truly organized criminal group.

Lewandowski about his client

Public opinion after the release of Romanowski questions why this situation occurred in the first place and who is liable for it. Invited to the RMF FM met. Bartosz Lewandowski, who is the defender of the arrested MP, has an opinion on this subject.

Lewandowski pointed out during the broadcast that the Minister of Justice and lawyer General Adam Bodnar were politically responsible. At the same time, the patron wondered if this would lead to Bodnar's resignation. He besides announced that a announcement should be submitted to the D.A. not only against prosecutors liable for illegal imprisonment but besides against persons who, under the authority of the Ministry of Justice, and specifically Deputy Minister Arkadiusz Myrchy, have produced opinions justifying the application of coercive measures despite their immunity.

Lewandowski described as a scandalous continuation of mining detention for another persons detained in connection with the Justice Fund.

Pronouncing lawsuits

Romanowski was busy and announced in his social media that he would submit a announcement to the D.A.

With my illegal detention, with mec. Bartosz Lewandowski will be sending a announcement to the prosecutor's office, including lawyers who wrote legal opinions on Arkadiusz Myrchy's orders – we can read on the policy profile.

Opinions were prepared by Dr hab. Andrzej Jackievicz from the Faculty of Constitutional Law of the Faculty of Law of the University of Białystok and Joanna Juchniewicz from the Faculty of Law and Administration of the University of Warmia and Mazury in Olsztyn.

The Minister of Justice, after reading the content of the opinion, decided to transfer them to the National Prosecutor's Office as additional supporting material for legal analyses of the Justice Fund.
