On Tuesday 1 July, the ultimate Court addressed the issue of the importance of elections for the president of Poland. The gathering of the full Chamber of Extraordinary Control and Public Affairs began around 13 p.m. The judges of the home considered the elections important. The gathering lasts 2 hours. Is the decision of the unrecognised Chamber important?
The ultimate Court resolution is essential to recognise the validity of the presidential election. By 2018, this decision was issued by the Chamber of Labour, Insurance and Public Affairs. After that, the Law and Justice decided to change the law and cede this work to the established neo-Judges Chamber of Extraordinary Control and Public Affairs. This Chamber is not recognised by the Government, the EU Court of Justice and the European Court of Human Rights.
Earlier, Minister of Justice and lawyer General Adam Bodnar had requested the Chamber of Control to exclude himself from ruling and giving decisions to the Labour Chamber. However, I president of SN Margaret Manowska refused.
It is so not certain that the resolution on the validity of the elections issued by the illegally acting Chamber will be formally valid. However, the talker of the Sejm, Simon Holovnia, announced earlier that the National Assembly would convene after the President's election was recognised as valid by the SN on August 6th. That's erstwhile Charles Nawrocki will take his oath and take office.
Prior to the designation of the validity of the elections, the ultimate Court rejected wholesale electoral protests, making it reasonable to consider only any of them.
