Karol Nawrocki's decision to curse in only 2 of the six fresh judges of the Constitutional Court caused a political storm. The president's back on the case in Channel Zero. He translated his actions, the oaths in the Sejm he called "circe", and the judges he referred to as "raptus".


On 13 March, the Sejm elected six fresh judges of the Constitutional Court, but in early April Karol Nawrocki accepted a vow from only 2 – Magdalena Bentkowska and Dariusz Szost. The remaining 4 were not invited to the Presidential Palace, which immediately sparked a sting between the government of Donald Tusk and the head of state.

The another judges – Krystian Markiewicz, Anna Korwin-Piotrowska, Maciej Taborowski and Marcin Dziurda – took an oath in the Sejm on 9 April, in the presence of marshals and notaries. They besides swore Bentkowska and Szostek. Although they formally said they were doing this "to the president of Poland", there was no Charles Nawrocki in the Sejm.

In Friday's interview at Channel Zero, Karol Nawrocki argued that he never closed the way for the another candidates to curse in. “I never said I would not accept a vow from the another 4 judges,” he said.

He added that his decision to curse only Bentkowska and Szostka was due to the request to guarantee the functioning of the Constitutional Court. As he pointed out, he had reservations about the procedure of all six judges, but had to take care of the minimum composition of the institutions.

– I had to weigh the rations of 11 Constitutional Court judges to guarantee the functioning of the state institution. I wanted the Constitutional Court to function and operate. And I chose two, and I swore two," he said.

At the same time, Nawrocki admitted explicitly that he was not formally competent to choice judges whom he would swear. “I was hoping that the Sejm would aid me and point out which justice is for whose judge,” he said. As he explained, he was put in a situation where he had to make his own decision. “I chose the judges I chose due to the fact that I did not receive any another indications,” he pointed out.

And the president didn't hide his anger due to the fact that the judges didn't wait for him to move. - Raptus these our judges. Soldiers are waiting for their officership degrees, professors are waiting... and 4 judges cannot wait," he said, stressing, "no 1 from the President's Chancellery, nor I, said we would not curse them."

In his opinion, the full situation aggravated what happened later in the Sejm. "It would surely have happened if it had not been for the circus that took place in the Polish Sejm," he said.

Charles Nawrocki will accept the oath of the another judges of the TK? That depends.

When asked if he intended to curse on the remaining 4 judges, Karol Nawrocki transferred work to the Constitutional Tribunal. As he stated, "everything is in the hands of the Constitutional Court", and in this situation "the constitution and the full strategy of Polish government and all laws is, in a sense, helpless".

The president did not hide that the situation was stale. "I do not know what the president is to do today, if the judges, without waiting, swore before the notary in the Polish Sejm," he said. He stressed that it was the TK that should find the consequences of the events at the Sejm and submit to it.

As Nawrocki announced, if the TK considers that it is essential for the president to re-appoint the judges, it will comply. However, if the Court considers that the events in the Sejm close the case, it will not take any further action.
