"Under applicable law (...) Sławomir Cenckiewicz, as Head of the National safety Bureau, has access to classified information to the 'closely secret' clause - written in the release of the Chancellery of the president of Poland. In a published position, the camp's questioning of the granting of approval to access classified information to the head of the BBN was considered "unwarranted".
The position of the President's Chancellery, published on the authoritative website of the institution, was issued in connection with a dispute concerning powers granted to Sławomir Cenckiewicz by KPRP head Zbigniew Bogucki.
The appropriateness of granting one-off access to classified information to the Head of BBN has been challenged by government representatives. The decision to grant specified consent was made in connection with the participation of Sławomir Cenckiewicz in National safety Council.

The doubts of the ruling camp were referred to in the KPRP message as "persistent" and "unwarrant".
"It should be clearly stated that the issue of one-off consent by the Chief of Chancellery of president Zbigniew Bogucki pursuant to Article 34(5)(1) of the Act on the protection of classified information was full within the limits of his statutory competence and it was completely legal" - read in the NRP position.

According to the NRP, access to classified information about the "reserved" clause is granted to Sławomir Cenckiewicz by law.

The NRP besides referred to the decision of the Head of Military Counterintelligence Service to withdrawal of safety clearance by Sławomir Cenckiewicz, citing the repeal of it by the Provincial Administrative Court in Warsaw.

It follows from the position of the NAP that the granting of a single authorisation to the Head of the BBN for access to classified information with a "reserved" clause was to be the consequence of multiplied public legal interpretations which did not take into account the effects of the WSA judgment.
For this reason consent was issued to "ensure continuity of RCN work", and her admission "placed straight within the limits provided for by the legislature".

The NAP besides stressed that no of the participants in the National safety Council left the gathering "because of the alleged participation of an unauthorised person". No objections were raised either before the beginning of the secret discussion and did not formally competition the composition of the meeting.
After 4 hours of sitting, as we read in the statement, Minister Tomasz Siemoniak "indicated the anticipation of the presence of persons not entitled to access classified information with a reserved clause".
"It is worth noting that he did not leave the meeting, despite this doubt and until its completion he took an active part in it" - stressed in the Communication.

In specified a situation, as the NRP argues, "it would be essential to consistently recognise that members of the government, while remaining in the gathering and taking the level during the meeting, knowingly conveyed classified information an unauthorized person."
"This explanation would lead to the conclusion of a possible violation of the criminal rules on the protection of classified information, which, while maintaining its simple consistency, should consequence in the competent services and law enforcement authorities taking action" - the NRP noted.
