The Lesser Poland Voivodeship filed a cassation complaint against the January ruling of the Provincial Administrative Court in Krakow on the Clean Transport region – Radio Kraków informed. It's about regulations that have introduced a region in the city in its current shape.
In the view of the voivodes, the resolution on the SCT as it stands violates the constitutional principles of proportionality and equality with the rights of citizens. In January, WSA mostly disagreed with this argument. After proceeding the written justification, the voivode assessed that the argument of the court was not convincing and decided to file a cassation complaint with the Chief Administrative Court.
The voivode maintains that the SCT principles in Krakow break the rule of equality and divide citizens, and Krakow, as the capital of Małopolska, is besides crucial a centre to restrict access to schools, hospitals, offices, as the councilmen did.
The lodging of a complaint to the NSA causes the judgement of the WSA to neglect and the destiny of the resolution to be settled by a higher court. While waiting for binding solutions to the dispute, the current rules of entry into the region will apply in Krakow. Unless president Aleksander Miszalski, under the force of criticism, makes the announced revisions of the SCT. These, however, besides require time. However, the president is cheering for a referendum on his dismissal.
