Every year in April, the Social Insurance Institution reveals the current rate of compensation for accidents at work. Under the applicable conditions, this sum is PLN 1269 for each percent of permanent or long-term harm to health. This value will stay unchanged until April 2024. However, it should be borne in head that the award of compensation by ZUS requires certain criteria to be met. There are besides exceptions erstwhile compensation for accidents at work is not granted.
Currently, the compensation for the accident at work, paid by ZUS, is PLN 1269 for all percent of harm to health. As of 1 April 2023 there was an increase of 136 PLN compared to the erstwhile rate, which was 1133 PLN. Earlier, in 2021, the compensation for 1 percent of injury amounted to PLN 1033 and in 2020 it was PLN 984.

Compensation for an accident at work shall be calculated on the basis of the degree of injury, expressed as a percentage, which shall be determined by the medical examiner or medical board. For example, the individual seeking compensation suffered a 5 percent injury, which means that according to the current rate he can receive PLN 6345 compensation, while another worker experienced a 10 percent injury and may receive PLN 12,690.
‘The assessment of the degree of this injury and of its relation with an accident at work or occupational illness shall be made by the medical examiner of the Social safety Office or the medical board of the Social safety Office after the completion of the treatment or rehabilitation process,’ explains Iwona Kowalska-Matis, spokesperson ZUS in Lower Silesia. They analyse the medical data and circumstances associated with the accident to find the wellness effects and the link between the injury and the workplace situation. Only after this assessment is it possible to find the amount of compensation.
A claim for damages. What papers do we request to study to ZUS?
In order to receive compensation for accident at work from the Social Insurance Institution, it is essential to submit an appropriate application and to supply a complete set of papers to the Social Insurance Institution. The papers essential for transportation include:
- Application for a one-time compensation.
- Accident protocol.
- OL-9 printed by the doctor, confirming the completion of rehabilitation, issued by the workplace.
The Social Insurance Institution has 14 days to decide to grant or refuse compensation. If the decision is favourable and compensation for harm to wellness is granted, it should be paid within a further 30 days.
It is essential to keep the provision of post-accident proceedings and to draw up reliable post-accident documents. This is crucial for determining the right of the insured individual to receive compensation," emphasises the spokesperson ZUS from Lower Silesia.
ZUS publishes a list of one-off compensation rates for accidents at work or occupational diseases in force during a given period, including between 2023 and 2024. Compensation for accidents at work is the most frequently awarded accident benefit. In 2022 ZUS paid PLN 326 million as one-off compensation. Rates applicable from 1 April 2023 to 31 March 2024 include, among others:
- PLN 1269 for each percent of permanent or long-term harm to health.
- PLN 1269 for each percent of permanent or long-term wellness harm due to an increase in this injury by at least 10 percent points.
- 22 212 PLN for full incapacity for work and incapacity for self-existence of the insured person.
- Different amounts for the entitlement of different members of the household of the deceased insured individual or pensioner to compensation.
These rates take into account different household situations and are a key component in determining the amount of compensation.
Accident and compensation. ZUS will not pay in this case
The provisions on compensation for accidents at work exclude 2 main situations where compensation is not available. The first concerns cases where an accident is due to a proven breach of wellness and safety by a individual due to intent or gross negligence.
The second situation, which excludes receipt of compensation, is the employee's engagement in an accident importantly influenced by psychoactive substances or alcohol. It is worth noting that this reason is not taken into account in the case of the death of an worker as a consequence of an accident.
