Jarosław Kaczyński rejected the proposal to settle a private indictment filed by Zbigniew Komosa – PAP learned from sources akin to the case. The territory Court for Warsaw-Śródmieście set the date of the proceeding on 23 April. The case concerns the October incidental last year. At that time, the president of the Law and Justice organization was to punch Komosa in the face.
“The court appointed a proceeding after the suspect did not take advantage of the anticipation of reconciliation,” informed the legal typical of the activist mec. Jerzy Jurek. He reminded that – according to the regulations – Kaczyński would not gotta appear personally at the court. At the same time, he announced the anticipation of requesting a witness hearing.

The investigation concerns an incidental of 10 October 2024, when, according to Komosa's accounts, Jarosław Kaczyński hit him in the face twice during the Smolensk monthly celebrations Piłsudski in Warsaw. Komosa filed a private indictment in this case with Article 217 of the Criminal Code (infringement of physical immunity).

In this case, Komos and his lawyer offered Kaczyński a settlement in December, during the procedure for the Sejm to waive his immunity. In exchange for public apology for the "lie about the assassination" in Smolensk, which was to be formulated by the president of the Law and Justice Party, Komosa declared to retreat the prosecution and resign from further action at the monument to the Smolensk Tragedy Victims.

The proposal was valid until voting in the Sejm, and another terms of the agreement were possible. yet on 6 December The Sejm waived immunity for Jarosław Kaczyński. 241 Members from KO, Poland 2050-TD, PSL-TD, Left, Together and 1 non-attached MP voted in favour of the proposal. There were 206 PiS MPs, Confederates and Free Republicans. No 1 abstained. The waiver of immunity allowed formal judicial proceedings.
