– On 25 November, the Court of Justice ruled that a associate State of the European Union is obliged to recognise the matrimony of single-sex couples in another associate State. The conviction came after Mr Matthew and Mr James fought in court to guarantee that their matrimony in Berlin was recognized in Poland.
"A very crucial ruling, the case was created due to the initiative of average citizens. The ultimate Administrative Court asked a question for a preliminary ruling, which is why the Court's ruling refers peculiarly to the Polish court case. In courts, citizens want to prosecute their interests. Sometimes government does not make direct institutions. For example, reprivatisation issues have not been regulated by law, but citizens have initiated proceedings aimed at the annulment of various nationalisation acts. In this peculiar case, people who wanted to kind out their individual affairs turned to court. The court never works out of office, and only if the average Nowak comes to us, will file a complaint and launch the full proceedings.
