Despite a good campaign, the vacation period is governed by its rights, so Poles are happy to get excited about non-political topics – most frequently they are any kind of bloated moral scandals, or manufacture scandals (and this vocalist has nothing to live for, and this celebrated athlete said something that delights any and offends others).
One of the hottest topics in fresh days in general (I think that in the age category "below 30" the case powerfully pierced the political track) became a journalistic investigation, which he conducted very reliably Krzysztof Stanowski about the celebrity and – as it turned out – the fake miss / stars Bollywood and Hollywood Natalia Janoszek. In 1 of the last episodes of the series "Diary Zero" Stanowski step by step, with awesome accuracy (he went to India for this purpose) and a considerable amount of journalistic work he analysed the young actress's "care" without partiality showing that almost each her “great success” was heavy colored, or even fabricated by the actor herself and her “team manager”.
Random Amusement
To tell you the truth, the full affair amused me very much, even though I had no thought of Janoszek's existence before reading the material on the Sports Channel, and I surely won't be following her career now, so I'm going to sum it up briefly at the very end of the text, and in the meantime, I'm going to explain why I even dealt with the case.
Yes, I admit: out of curiosity (I always say that if I always die in an accident, the origin will be curiosity) I included this episode of “Journalist zero” due to the fact that virtually everyone around me was talking about how this young girl had been flying the Polish media for respective years as a large star of planet cinema, and I didn't really know who she was talking about.
I must say that I truly had a large time watching this “on the occasion” at work. As it is said today, “material made my day.” Mr. Stanowski with themes he talks about and guests he invites is not peculiarly in my interest. Earlier I saw virtually respective episodes of his programs, which, by the way, made me feel very ambivalent. While I was alternatively prepared to agree with his position regarding the reprographic charge, which is any kind of curiosium, inviting and "pumping" as conflict specialists in Ukraine Jack Bartosiak and Jack Zychowicz I consider it simply a harmful phenomenon, which unfortunately, in broad public opinion, gives publicity to the nonsense that these 2 tell with the faces of mentors. I besides had a large time watching an episode with (yet) the president Janusz Korwin-Mikke – pure gold and essence, “corvinated” under cork!
Returning to the subject, however, the episode on Natalia Janoszek's career, which was "split down" and exposed as completely fictional, provided me with as much fun as reflection. But from the very beginning I noticed the musical setting of the same, and this is due to the fact that I like music very much Edity Bartosiewicz.
Right of quote?
It was the song "I lied" that the artist utilized as a "soundtrack" for a long, almost three-hour material, bravado prepared by Krzysztof Stanowski. This resulted in a media dispute between the vocalist and the Sports Channel, because, as Edyta Bartosiewicz informed through social media, Stanowski did not ask about the anticipation of utilizing the song in his material, which had a character (speaking very diplomatically) powerfully critical of the Polish actress.
Edyta Bartosiewicz referred to the situation in 2 entries:
"A friend just called and asked if I was watching the latest movie by well-known vloger Krzysztof Stanowski on YouTube. They say that parts of my 'I lied' song appear there. I didn't want to enter the designated Sports Channel, and I started going through almost 3-hour footage, exposing any showbiz lady. In fact, the song appears there respective times in short appearances, being a kind of musical theme, illustrating the subject leading the media behind the celebrity's nose. Mr. Krzysztof put himself to work, I must admit it, he just forgot to ask me approval ...”.
A day later, she wrote:
"Dear Mr and Mrs, I wrote all my songs with a view to bringing a affirmative message. I don't want to see them in any way to go after individual who may have any serious personality disorder. I anticipate an apology from Krzysztof Stanowski for utilizing fragments of the song 'I lied' without my permission, removing them from my movie and paying the appropriate amount to the charity I indicated. P.S. All rights to my songs are on my side”.
Naturally, in consequence to the artist's message, comments from fans of the Sports Channel appeared online, which can be put in a nutshell (I paraphrase due to the fact that it is simply a waste of your time to quote):
“Bartosiewicz is looking for publicity and wants to renew his career after years at the expense of Stanowski, who has legally utilized her song based on the ‘right quote’. Let him be glad that individual else wants to hear those hits from the 1990s. Her ‘dramatization’ distracts from the essence of the matter, which is the hoax of her own career by Natalia Janoszek.’, etc.
Well, then, let us remind you of the law that the commentators cite:
‘Article 29. [Right of quote]
It is allowed to quote in works which constitute a self-contained full of fragments of widespread works and widespread works of art, photographic works or fine works in their entirety, to the degree justified by the purposes of the quote, specified as clarification, polemics, critical or technological analysis, teaching or rights of the genre of creativity."
The only problem is that the way in which the song was utilized in the "Journalist zero" does not fall within the definition of Art. 29. We are not here to quote the song in order to review it, nor to explain it, polemics or any analysis. This song was utilized due to the fact that the lyrics of the chorus and passages of the verse simply matched the subject of the episode and perfectly emphasized it. It is not about 1 short fragment – the song scrolls through the full movie material and enters (various passages) many times creates a circumstantial "soundtrack". The Sports Channel is presently the largest media of this kind on Polish YouTube, and their displays go into millions, so the monetization is at a very advanced level and I emphasize – I have no problem with that. Especially due to the fact that I like the music of Edyta Bartosiewicz very much, and the lyrics of this song were very good for Janoszek:
"I lied, I lied. I sucked my fingers out... You'll never know what's actual and what's a lie. And before I tell you, I most likely made it up again. I'm cheeky again, I'm not remorseful. Oh, no, I don't feel guilty at all. I wouldn't be myself if I were different...”
The song Edith Bartosziewicz, like respective others, was a large hit in the 1990s. in Poland. Up until now, frequently guests on radio stations and is performed by the vocalist during concerts.
“I lied” – music, words and arrangements: Edyta Bartosiewicz. It premiered in 1997 through Universal Music Polska. The only copyright holder for the song is the artist herself.
The scandal came to an end rather rapidly after the ZAiKS message on this issue (also on social media):
"The right to quote has rather serious conditions to meet. As far as the fresh issue of the usage in his material by a journalist/youtuber of a song known as the creator is concerned, the usage of fragments of her song for this circumstantial video production has nothing to do with the conditions that specify the right of quote”. In another thread they add: ‘(...) For various reasons the creator may not want specified use, so his consent is essential and he is guaranteed copyrights, which are inalienable and always available to the creators of the work. (...)’.
We didn't wait long for the Sports Channel writer to respond. In my opinion, she was unnecessarily maligned, but well – that's Stanowski's style:
"I truly don't gotta do this due to the fact that I have it all figured out, but first, since Edyta Bartosiewicz doesn't want her song to be so associated with the subject of intellectual disorders, I respect it, and secondly, I don't want this crucial subject to be watered down by an absolutely eighth-rate thread (and I see that any have already begun to act this way), so we have muted any passages. erstwhile the file is processed (which may take 24 hours) it will be possible to enjoy a fewer seconds of silence.”.
Mrs. Edyta seems satisfied with the result of the case, as she no longer refers to the situation in any way officially and refuses to comment on it.
Bad conclusions...
The case between the vocalist and the writer has spread to the bone, so could you ask why I'm writing about it?
First of all, the situation shows that YouTube one more time treats creators very differently and has nothing to do with copyright. Many “jutubers” have already learned about the dual standards of “media colossus” and we have not missed the problems. On the occasion of 1 of the last episodes of the "A small Culture" cycle, we wanted to include short fragments of our favourite films in the law. I stress – to discuss, review, analyse and commandsOh, my God! In my opinion, these intentions are full in line with Article 29, and yet the portal has 3 times removed material from us due to the usage of these passages, until yet col. Przemysław Piasta He had to reduce it to a minimum.
Meanwhile, the Sports Channel takes on the track by Edyta Bartosiewicz, placing it in its material, in a certain context, as a stopover and YouTube has no problem with it. Only after the intervention of the artist is the Polish institution liable for copyright protection.
The same is actual of the content on YT – any "jutubers" can discuss very controversial subjects, but those entering any narratives, and others will be removed (with channels) only for presenting facts. This was the case, for example, erstwhile the Sports Channel interviewed a mercenary fighting in Ukraine who said that he went there "to kill Russians in retaliation for his grandfather." Here too, YT did not see any breaking standards, and the display of the episode was huge.
I think that the situation with the "becoming star" could give another chance to rise the subject on legal grounds and standardise standards for all creators. Unless the American company is operating outside the law...?
‘Freedom’ septic tanks
Another issue is the wave (talking softly) of unfavorable comments about the intervention of Edyta Bartosiewicz. Especially active were the supporters of the alleged freedom right and the wider "free market". I think that the cesspool that has struck them on the net has exceeded the expectations of even Krzysztof Stanowski, who is celebrated for his very strong views on issues specified as the reprographic fee.
I know that any of our Readers sympathize with the alleged freedom stream, but it would be worth remembering that there is something like copyright (whatever they think of them). After all, it is entirely reasonable for the creator to decide where his works will be utilized (recollecting) – not to review them or even to criticize them, but as a basis for the presented thesis, whether it is right or not... I do not realize where controversy and a place for aversion, which (about horror) were besides shown by any creators of the Internet?!
Did the vocalist decide to usage this minute to “seek attention”? In a way, I'm sure, but I'm not making a charge of it! The situation was not "a set-up" between the artist and the athletics Channel. I questioned respective people in the manufacture who know Bartosiewicz and they all confirmed that she was genuinely amazed by what happened. However, if the biggest channel on Polish YouTube decided to usage her music and text without permission, it is natural that she reacted, and this reaction aroused any sensations. We are not dealing with a fabricated celebrity, about which material Stanowski made, and with an authentic star of the Polish song. By the way, Mrs.Bartosiewicz is simply a full artist – she writes music, words, arranges and produces her works. Plus, she's a very modest woman, never taking part in inexpensive scandals. Her songs remind me of the youth and tv charts of the hits "30 Tons" (everyone waited in 1990 for further releases). I so believe that it was the "action" that found it, and that the momentous scandal is only a side effect of the situation.
I am besides pleased that the case has been resolved with class, and as regards Stanowski's material on Janoszek...
Real journalistic zeros!
In my opinion, Krzysztof Stanowski, utilizing this seemingly trivial example, exposed and completely erased all the alleged journalists who were disillusioned with the "great career of Poland in Bollywood and Hollywood". Indeed, the level of these “talking heads” and the magazines of colour is simply embarrassing. It did not take a large “investigation” to establish facts about Janoszek, who in Poland effectively told everyone that she was a large star in India, and there she tried to convince that she had specified position in Poland. "Wicious stare!". This girl spent respective years on the antennas of the biggest Polish tv and radio stations, and was “mocked” by mediocrity, which carelessly, without any verification reproduced nonsense about her bravado career!
In fact, this pretend star/miss and her "team manager" are the winners of this situation – since 2014 they have been energetically "surfing" on the infidelity and foolishness of journalists of various tabloids, who were not even bothered by the fact that Mrs.Natalka was able to give mutually exclusive answers in 1 interview! After all, quite a few money and contracts followed (it is said that they all have already lost). It's truly cute...
I would very much like individual to look at the careers of popular “experts” from politics, militarities, geopolitics, global relations and another “leaders of the public”. I would like to be even more acquainted with specified a "vivisection" of parliamentary politicians and those aspiring to the Sejm (Mrs Janoszek has already passed as an alderman) – this would surely be much more interesting and undoubtedly very instructive.
