A coup investigation. TK accuses the Tusk government

The president of the Constitutional Tribunal Bogdan Świętczkowski announced that an investigation was initiated concerning suspicion of coup. The case concerns Prime Minister Donald Tusk, key ministers and Speakers of the Sejm and the Senate. According to the notice, the current authority was to act to change the state's strategy and undermine the function of the Constitutional Court. The investigation is conducted by Deputy lawyer General Michał Ostrowski.

Charges against the Government

Bogdan Świętczkowski made a comprehensive notification in which he pointed out actions which, in his opinion, violate the constitutional order of the state. Among the charges were the examination of the position of ultimate Court judges and the Constitutional Court. According to the president of the Constitutional Tribunal, the government was to act in a coordinated manner, seeking to weaken state institutions.

The announcement includes respective twelve people, including Prime Minister Donald Tusk, ministers, Speakers of the Sejm and the Senate, as well as elected judges and prosecutors. As Święczkowski stressed, it was a "organised group" which was to act in a short time to harm the state.

Constitutional Court vs Government – coup d'état

The dispute between the Constitutional Tribunal and Donald Tusk's government has continued since the beginning of the fresh term. 1 of the key points of the conflict is the refusal to print the decisions of the Constitutional Tribunal by the Government Legislative Centre, which undermines the legality of the Court's actions. In addition, the Sejm adopted a resolution aimed at "removing the effects of the constitutional crisis" from 2015-2023, which, according to Świętczkowski, fits into the actions leading to the weakening of the Constitutional Tribunal.

Bogdan Świętczkowski informed that he had already been interviewed as a notifier. The case is handled by D.A. Michał Ostrowski, who initiated a formal investigation. What will be his next steps? This may depend on the political situation and possible decisions of the courts.
