Investigative squad No. 4 of the National Public Prosecutor's Office conducts 7 proceedings concerning irregularities related to the activities of the Smolensk Subcommittee. Cases affect various negligence and concern different people. Key findings indicate that it cannot be excluded that Antoni Macerewicz will besides hear allegations. As Przemysław Nowak said in an interview with “Polsat News”: “It cannot be excluded that he will besides hear allegations.”

The first charges have already been heard by Wenceslaw B., erstwhile president of the Smolensk Subcommittee. The charge concerns obstruction of the investigation into the Smolensk disaster (so-called partisanism). He's facing 5 years in prison. The evidence received enabled the prosecution to be prosecuted – obstruction of investigation – about the disaster, as explained by Przemysław Nowak.

One of the threads of the investigation concerns the disappearance or demolition of material evidence that has been transferred to the Smolensk Subcommittee. Most of these items have not yet been found. Investigators are trying to find what happened to them and who is responsible. As Przemysław Nowak said, “There is an investigation that determines what happened to these things and who is responsible.”

It is worth noting that the National Prosecutor's Office has been investigating irregularities in the Smolensk Subcommittee since 2016. respective charges have already been filed, including obstruction of investigation and prosecution. Investigators from the National Prosecutor's Office are constantly working to explain the circumstances of the Smolensk disaster and to hold the liable persons responsible.

According to the National Prosecutor's Office, 234 investigations concerning the Smolensk disaster were completed in 2022, including 157 cases concerning irregularities in the Smolensk Subcommittee. In the same year, the National Prosecutor's Office filed a full of 345 charges in cases related to the Smolensk disaster.

It is worth recalling that the Smolensk disaster occurred on April 10, 2010, erstwhile Tupolev Tu-154M plane crashed in the forest under Smolensk, killing 96 people, including president Lech Kaczyński and his wife Maria Kaczyńska. The National Prosecutor's Office has been investigating the Smolensk disaster since 2010, and in 2016 a peculiar enquiry commission on the Smolensk disaster was established.
