In 2025 Polish companies have the chance to usage maximum electricity price set at PLN 693/MWh. However, in order to keep preferential price conditions, certain formalities must be fulfilled within the prescribed time limits.

Obligation to make a declaration

Undertakings which benefited from the maximum energy price during the period 1 July to 31 December 2024 are required to make a declaration. Initially, the deadline for the transportation of this paper expired February 28, 2025. However, Ministry of Climate and Environment is working on extending this word to June 30, 2025to make it easier for entrepreneurs to complete the formalities

Who's the duty?

The work to make a declaration concerns first and foremost micro, tiny and medium-sized enterprises (SMEs)which have benefited from the maximum electricity price mechanism. It is worth noting that failure to make a message within the required time limit may consequence in the request to reimburse the difference between the price resulting from the contract and the maximum price, together with the interest accrued

How do I make a statement?

To benefit from a preferential energy price, entrepreneurs should:

1. Download the current pattern of the statement – available on energy retailers' websites or on authoritative government portals.
2. Complete document, giving the essential company data and confirming the usage of the maximum electricity price.
3. Send a completed statement to its energy seller – this is possible in both paper and electronic form.

The Ministry of Climate and Environment, listening to the voices of entrepreneurs, plans to extend the deadline for making statements by 30 June 2025. The intent of this amendment is to supply companies with additional time to complete the formalities and to avoid possible financial sanctions for default within the first deadline.

Companies which do not make the required message within the time limit may be required to reimburse the difference between the contract price and the maximum price, together with the interest accrued. For many companies, this can mean a crucial financial burden, especially in the face of rising operating costs

In order to keep preferential electricity price conditions in 2025, undertakings should immediately:

• Download and complete the current model of the statement.
• Make a paper to your energy seller in paper or electronic form.
• Follow the reports of the Ministry of Climate and Environment on possible changes in the deadlines for making statements.
