"I object to non-compliance with the Constitution". There's a decision by president Duda on the hatred speech bill

"President of the Republic of Poland Andrzej Duda directed to the Constitutional Court, under preventive control, the Act of 6 March 2025 amending the Act – Criminal Code" - informed the President's Office in a communication.


This is simply a government amendment to the Criminal Code on hatred speech and hatred crimes, which extends the catalogue to offences motivated by discrimination based on age, disability, sex and sexual orientation. They were to be punished on akin terms as before, already included in the government (because of national, ethnic, racial, political, spiritual or non-religious affiliation).


The president accuses the Act of non-compliance with Article 54(1) of the Constitution of Poland (Everyone shall be given the freedom to express his views and to get and disseminate information) and Article 31(3) (Restrictions on the exercise of constitutional freedoms and rights may only be laid down in the Act and only if they are essential in a democratic state for its safety or public order, or for the protection of the environment, wellness and public morality, or for the freedom and rights of another persons. These restrictions must not affect the essence of freedom and rights).
