Marshal of the Sejm Szymon Hołownia, in his latest thought of solving the problem of legal abortion, proposed the adoption of 2 draft laws. Holovnia thinks his proposals can break the impasse in parliament. The first project, by the 3rd Way, would reconstruct the alleged abortion compromise, and the second, improved version of the Left would decision towards decriminalization of abortion.
In mid-July, the Sejm rejected the amendment to the Penal Code, brought by the Left club, which aimed at partially decriminalising abortion. The draft provided for the repeal of the provisions of Article 152 of the Criminal Code, which supply for 3 years in prison for termination of pregnancy in cases contrary to the law and for urging this. He besides introduced penalties for limiting freedom or imprisonment to 5 years for abortion after 12 weeks of pregnancy, unless there were serious birth defects threatening the life and wellness of a woman.
During the open gathering of the Polish 2050-TD club in the Sejm, Hołownia pointed out 2 options after rejecting the Left. The first is to proceed the conflict around abortion laws, which could lead to a deficiency of any change in abortion law and a deficiency of "advantage" for women. The second option, more pragmatic, consists in the simultaneous adoption of 2 laws: the 1 restoring the abortion compromise proposed by the 3rd Road, and the revised Left Act on the decryminalisation of abortion.
"We have a choice: either we will have an unadopted bill again, or we may have 2 passed laws by the end of the year," said Holownia.
He hoped that the 3rd Way Act would come out of the abortion committee, which could be adopted by the Sejm to a much greater extent, and with it improved the Left.
The Hołównia believes that passing both laws can be a realistic scenario. He pointed out that specified an approach could satisfy the various sides of the debate, giving each of them the feeling that they have achieved something
"We know that with 1 bill it will most likely be the same, but if we gave two? 1 that does not solve all the problems, but causes us to be in another place and the other, which is crucial to this site, which presents a somewhat different approach to the case. And any would feel that something crucial had been done about it, and others. And that may be the measurement of consensus that we can afford, due to the fact that another Sejm will not be there until 2027," said the marshal.
The 3rd Way task proposes a return to legal position before the 2020 Constitutional Court judgment, restoring abortion in the event of a child's serious defect. In addition, the 3rd Road wants to hold a referendum on abortion rules to give the public an chance to express their views on this.
Of course, it is hard not to announcement that the referendum on abortion proposed by the Holovnia on issues of life and death, as if it were a substance to be decided on the ballot. After all, all abortion is the killing of a child, and restoring the legal state before the 2020 Constitutional Court's judgement would mean a public violation of the Polish constitution that protects life from conception.
