The worker then turned to the Hague territory Court, demanding compensation. Jan ego Muslim lawyer argued that the termination of the employment contract was unlawful due to discrimination on the grounds of religion. Thus there was a legal conflict between feminism and Islamism.

The justice ruled that the dismissal of a Muslim was discrimination on grounds of religion. "Especially in an organisation specified as COA, men and women should be treated as equally as possible. This in itself is simply a legitimate objective. However, this is balanced by the right to non-discrimination on the grounds of religion."

In the case of an IT employee, the court considered that his spiritual beliefs were of greater importance. "The contact with customers and colleagues would be mainly by telephone. Consequently, there is insufficient evidence that the position would require hand-in-hand.”

Since the dismissal was invalid and discriminatory, the justice ordered the employer to pay crucial compensation. Refusing to shake hands and only 4 days of work brought him EUR 34,000. His erstwhile employer besides has to reimburse him with EUR 1,600 in court costs.
