Anniversary of the arrest of suspects in the PiS's fake Land affair.
Today in our calendar, we will look at the spheres of the Land affair, which broke out in late August 2007. It contributed to the end of the PiS-LPR-Self-defense coalition and to accelerated elections.
The ground issue is 1 of the most celebrated affairs of Law and Justice. It concerns the action, which was prepared by secret services in order to compromise Andrzej Lepper – the head of the coalition of Self-defense of the Polish Republic. It was about removing the coalition player from the political phase and taking over his electorate. The manager of the action was the Central Anti-corruption Office with Mariusz Kamiński and Maciej Wąsik at the head. The Minister of Justice and the lawyer General agreed to carry out the action in 1 – Zbigniew Ziobro.
The action yet led the government of Jarosław Kaczyński to fall, and Mariusz Kamiński to the conviction of 3 years of ruthless imprisonment. A fewer years later, the mysterious deaths of Andrzej Lepper and his close associates besides occurred. It all started with lawyer Andrzej Kryszyński, who in 2006 was vice president of Telefonia Dialog belonging to the state giant KGHM Polska Miedź SA. On 9 July 2007, president Lech Kaczyński dismissed Minister of Agriculture Andrzej Lepper at the request of Prime Minister Jarosław Kaczyński. On 8 August 2007, the Minister of the Interior and Administration, Janusz Kaczmarek, was resigned. 3 weeks later, on August 30, Janusz Kaczmarek and Ryszard Krauze were arrested on suspicion of false evidence by the interior safety Agency. Kaczmarek besides heard the charge of obstruction of justice.

Piotr Ryba came out of jail after 12 months, and Andrzej Kryszyński after 10 months.
After the release of Andrzej Kryszyński's arrest, interesting facts about him came to light. Kryszynski turned out to be a erstwhile officer of the State Protection Office. In 2009, the prosecution withdrew from the allegations made by Janusz Kaczmark and Ryszard Krauze, stating that: "in the case of obstruction of justice conducted by the territory Attorney's Office in Warsaw, false evidence was exercised by their rights of defence Kaczmarek lied during his evidence that he had not met Richard Krauze.
He testified even at a time erstwhile he was only a witness, who is known to be formally testifying after being held liable for false testimony. In this case, however, the prosecution applied a very correct explanation of the ultimate Court of 26 April 2007 (OSNKW 2007/6/45 – Resolution I of KZP 4/07). The ultimate Court has concluded that the witness has the right to give false evidence in a case in which he can be charged.
Thus, a witness who may anticipate charges has the right to lie just as much as a individual with allegations already made. It's a fundamental right not to supply evidence of itself. Also, the charge of obstruction of the investigation by Janusz Kaczmark was found unconfirmed. The proceedings against Janusz Kaczmark and Ryszard Krauze were dismissed.

A period after the lawyer – in June, Lepper's close colleague Wiesław Podgórski committed suicide. A period after Podgórski – in July, in Moscow, Lepper's attorney, Rose Żarska, died suddenly. A period after that, Andrew Lepper died.
On October 6, 2009, Bogdan Olewiński – the Prosecutor's Office of the territory Prosecutor's Office in Rzeszów, in connection with the ground affair, accused the Chief of the Central Anti-corruption Bureau of Mariusz Kamiński of exceeding his powers and committing crimes against the reliability of documents. Piotr Ryba and Andrzej Lepper (then alive) were given the position of victims.
The D.A. concluded that the CBA had framed the full corruption case at the Ministry of Agriculture. It was the CBA that created the false documentation needed to deroll the land in Mazury. The bribe itself was declared illegal. According to the prosecutor's office, Mariusz Kamiński incited the crime of subordinate officers. The indictment against Kamiński was brought to court in September 2010. Prime Minister Donald Tusk resigned Mariusz Kamiński from the position of head of the Central Anti-corruption Bureau. His successor was Paweł Wojtunik, who made the decision to release Mariusz Kamiński from his service.
In March 2015, the territory Court for Warsaw-Śródmieście found Mariusz Kamiński guilty of exceeding his rights and sentenced him to 3 years of absolute imprisonment and a 10-year ban on taking positions in public administration and state institutions. Along with Kamiński, his deputy – Maciej Wąsik, was convicted, whose court sentenced 3 years of imprisonment. The justice in the trial was justice Wojciech Więczewski. In the message of reasons for the judgment, the justice agreed with the previously cited position of the prosecutor. He confirmed that there was no legal and factual basis for the initiation of the CBA operation, and Mariusz Kamiński planned and organized the full provocation and instigated corruption.
Before the court ruling had passed, president Andrzej Duda applied the law of grace to Mariusz Kamiński and Maciej Wąsik on 16 November 2015. This provision is absurd, as Mariusz Kamiński and Maciej Wąsik were not yet legally convicted. According to the law, conviction occurs erstwhile the conviction is finalized. In the case of Kamiński and Wąsik, the conviction was inactive invalid.
In fact, at the time of President's pardon, they were not convicted yet. The president cannot pardon those who have not been convicted! On May 31, 2017, the ultimate Court declared the act of grace of Andrzej Duda towards Mariusz Kamiński and Maciej Wąsik to be ineffective due to the fact that “A pardon before the minute of finality of the judgement has no legal effect‘.
On July 17, 2018, the Constitutional Court, at Zbigniew Ziobro's request, ruled that the pardon was lawful, due to the fact that president Andrzej Duda in his wisdom applied the alleged act of individual abolition, and specified an act prohibits the initiation of proceedings against a peculiar individual and orders the suspension and remission of proceedings already initiated against him.
After specified a ruling of the Constitutional Court, the Master of the Academy of Fine Arts opened the unknown legislative way to pardoning people for the future. The president may already pardon even those against whom no action has been taken and no action has always taken. Just wait until president Andrzej Duda pardons for the future and forever all his colleagues from the Law and Justice Union. After the land scandal ended, the time came for the revenge of the Law and Justice on the people who led to the conviction of Mariusz Kamiński and Maciej Wąsik. On April 20, 2016, Zbigniew Ziobro as lawyer General demoted Prosecutor Bogdan Olewiński from his post as Deputy territory lawyer in Rzeszów and transferred him to the lowest level, i.e. to the territory Attorney's Office.
Then the same Zbigniew Ziobro but already as the Minister of Justice, moved justice Wojciech Więczewski from the criminal department of the territory court to the civilian department in which he had never ruled. In 2019, justice Wojciech Więczewski, having experienced many harassments, resigned from the office of judge.
Mariusz Kamiński, on the another hand, has been promoted and is presently Minister of Interior and Administration and Coordinator of peculiar Services in the current Government of Law and Justice with adjacentities. Maciej Wąsik besides promoted and became Kamiński's deputy at the Ministry of abroad Affairs.
