Women born between 1949 and 1952 should not quit on seeking a recalculation of their pension simply due to the fact that they were eligible to apply for a general pension before 2013. The operative part of the Constitutional Tribunal’s (“TK”) ruling in case no. SK 140/20 does not exclude women born in those years, and the TK’s decision from June 2026 provides them with another crucial argument. Meanwhile, the October ruling by the Court of Appeals in Kraków shows that even a female born in 1952 can get at least a partial reversal of deductions made from her previously received pensions. In my opinion, there are grounds to request even greater protection,” writes lawyer Konrad Giedrojć.
