Giant penalties for Poland. EU Minister announces next steps

After consideration Complaints Polish Court of the European Union ruled on Wednesday that reduction of around €320 million of penalties by the European Commission in the absence of suspension of the Disciplinary Chamber of the ultimate Court was lawful. Poland may appeal this ruling within 2 months and 10 days from the date of notification of that decision.

– Although this is the sole work of the Law and Justice, we will appeal this decision, due to the fact that we want to usage all legal option to get the money back for Poland – he announced on Wednesday Minister for EU Affairs Adam Szpiecka.

Minister declared that Government will search specified legal solutions, which will increase the likelihood of effective cancellation, but is aware that "the situation will be very difficult".

As he pointed out, together failure of Poland resulting from the “constituency of the erstwhile government” of the Disciplinary Chamber cost Poland EUR 500 million. – The bill introducing the Disciplinary Board in the ultimate Court was voted by 233 Members of Law and Justice, i.e. each bears individual work for about €2 million - He said.

Poland has brought 3 actions before the Court in Luxembourg for annulment of six Commission decisions on the levy covering the period from 15 July 2022 to 4 June 2023.

This is the period from the date of entry into force of the bill on the ultimate Court, abolishing the Disciplinary Chamber (15 July 2022) to the last day on which Poland was punished (4 June 2023). On 5 June 2023, the TEU issued a judgement on the Disciplinary Board.
