About his first court triumph over president TK, Roman Giertych reported on platform X. "Mr Bogdan Święczkowski lost to me present the case of impudence, which he gave as the National Prosecutor as if I had committed any crimes while serving Polnord," he wrote.
Giertych won with Święczkowski. He's waiting for an apology.
"He is to apologize on the 1st side of the Republic, where there were his speeches and pay me 30 thousand," added the lawyer and MP. His entry was accompanied by a scan of the first page of the judgement dated April 17. The Warsaw-Prague territory Court obliges Bogdan Święczkowski to apologize to Giertych and details the form of these apologies.
The president of the Constitutional Tribunal is to print in “Rzeczpospolita” a message in which he admits to providing false information about Giertych’s alleged engagement in a group of serious economical offences and money laundering. He must besides point out that the publication of an apology is the consequence of a lost trial.
Of course, Świętczkowski has already announced an appeal against the judgment. On the authoritative profile of the Constitutional Tribunal on X, the "communication concerning the judgement of the territory Court in Warsaw in the case of Bogdan Świętczkowski" was published. It states that "the judgement violates the fundamental rights of public office and the constitutional right of the citizen to information".
"On the basis of the Constitution, a citizen has the right to get information on the activities of the public authority and, in accordance with Article 12 of the Law on Public Prosecutors, prosecutors have the right to communicate to the media information on the ongoing investigation or on the activities of the prosecutors", we read further.
Święczkowski will apologize for his words about Gierty?
Let us remind you that the process afraid words which fell in Bogdan Święczkowski's interview for “Rzeczpospolita” in 2020. It was then intended to propose that the prosecution had ‘strong evidence’ against Gierty, related to its legal activities for Polnord. According to the court, these words violated Roman Gierty's individual welfare.
In January of that year, the Regional Prosecutor's Office in Lublin dismissed the investigation against Roman Giertych concerning actions to harm Polnord. It was found that there was no crime.
