German police in Poland

The subject of German police presence in Poland became public after Aleksandra Fedorska, a journalist, among others, Tysol.pl and the editor-in-chief of Radio Debate, addressed a question to the German police station in Ludwigsdorf. It afraid the presence of a German police car, which patrolled the Polish side of the bridge in Zgorzelec.

In response, the German services referred to an agreement between the Polish and German Government of May 2014 concerning cooperation between police, border guards and customs services. According to information provided by the German authorities, the principles of this cooperation have been laid down in the German authoritative diary of the Laws.

Powers of German Services in Poland

It turns out that in fact the Polish-German agreement of 2014 gives German services extended powers in the territory of Poland.

Within common patrols may include:

- identify persons,
- to check identity papers and vehicles,
- detain Polish citizens,
- patrol the border area,
- carry out customs checks,

German services – with approval of the Polish side
may operate under cover and
- establish border inspection posts in Poland

However, the point is that in order for the German police to be able to carry out these activities – in accordance with Article 5 of the 2014 Agreement – the Polish services must first send a written request to the German services.

The Polish request is simply a fundamental condition for German police to take any action in Poland.
