European Order for Roman Arrest. The Hungarian court decides to issue the policy

The procedure has begun.

According to the information provided by the Hungarian Ministry of Justice, the case of Marcin Romanowski went to the Budapest Metropolitan Court, which means that the procedure for the execution of the European Arrest Warrant began in Hungary. These procedures are identical in the EU countries.

The proceedings concerning the erstwhile Deputy Minister of Justice in the Government of the United Right will be conducted by the Hungarian court and Poland will be represented by the Hungarian prosecutor. However, the court will not examine the merits of the charges against the suspect, but will focus only on procedural aspects, including the assessment of the admissibility of the transfer of Marcin Romanowski to Poland.

Marcin Romanowski, who is accused of committing 11 crimes, including participation in an organized crime group and manipulating competitions for funds from the Justice Fund, received political asylum in Hungary in December.

On Monday 20 January, the Ministry of Justice of Hungary informed the National Prosecutor's Office of the transmission of the European Arrest Order issued in connection with the individual wanted, Marcin Romanowski, to the Metropolitan Court in Budapest.

Accused crimes

Marcin Romanowski, erstwhile Deputy Minister of Justice and PiS MP, is suspected in an investigation into the Justice Fund. The offences he committed were intended to include, among another things, to indicate to his employees the entities that should win competitions for grants from the Fund.

Romanowski was besides expected to order improvements to the incorrect offers before they were submitted and to let grants to entities that did not meet the required formal and substantive criteria. In addition, the allegations include an appropriation of over PLN 107 million and an effort to claim over PLN 58 million.

Asylum officially granted

On 19 December 2024, Mr Bartosz Lewandowski informed that the Hungarian government had taken into account the request of Mr Marcin Romanowski and granted global protection under the Law on the Law of Asylum of 2007, indicating the actions taken by the Polish Government and the National Prosecutor's Office, which were to violate his rights and freedoms.

Proxy Romanowski pointed out that this was the first case of granting global protection to a Polish politician by another country after 1989. Later, the head of the office of Prime Minister Viktor Orbán and Vice-President of Fidesz, Gergela Gullyás, confirmed the granting of asylum to the Polish parliamentarian.
