Entrepreneurs critical of the National Cybersecurity Act

The draft of changes to the National Cybersecurity strategy Act prepared by the Ministry of Digitalization met with many critical remarks from entrepreneurs.

Min. Agnieszka Majewska – The Ombudsman for tiny and average Entrepreneurs has given the Minister of Digitalism a number of comments and is closely monitoring the advancement of the project.

Many doubts have been clarified, but business concerns are inactive raised by the procedure and the consequences of considering supplier as a high-risk supplier.

This case was discussed, among another things, at meetings within the Business Council of the SME Ombudsman of the Competition and Telecommunications Working Groups. The experts in the task stressed that the task implements EU government in a way that is incompatible with the government's fresh deregulation demands and imposes on Polish entrepreneurs a burden far beyond the requirements of the directive. The definition of a high-risk supplier is peculiarly questionable.

Request for an additional agreement conference by the MF on the provisions of Chapter 12a

Follow those voices of mine. Agnieszka Majewska wrote to Deputy Prime Minister Krzysztof Gawkowski. It calls for the Ministry to organise an additional consultation conference on the provisions of Chapter 12a "Special actions to guarantee cybersecurity at national level". At the same time, the SME Ombudsman calls for a binding consultation of the decision to recognise the supplier as a high-risk supplier with ministers liable for State safety and the economy, as well as with the law enforcement body on business rights.

According to Agnieszka Majewski, this would improve the transparency and reliability of specified decisions and at the same time limit their freedom and discretion, which is of large importance in the context of the impact of specified decisions on entrepreneurs utilizing pre-purchased equipment and the request to retreat them from use.
