It will be prohibited to sale all e-cigarettes, which are besides free of nicotine and nicotine bags, to people under the age of 18 – president Andrzej Duda signed an amendment to the Act on this matter. The ban will enter into force 14 days after the publication of the novels in the authoritative diary of the Acts.
It is simply a revision of the wellness Protection Act against the consequences of tobacco and tobacco use.
Amendment introduces ban on the sale of all types of e-cigarettes and nicotine bags to persons under 18. In shops where these products are available, the following information will appear: ‘No sales of tobacco products, nicotine bags, electronic cigarettes or spare containers to persons under 18’.
It will be prohibited to sale e-cigarettes without nicotine and long-distance nicotine bags, including via the Internet, and to advertise them. Electronic cigarettes, spare containers and nicotine bags cannot be sold in vending machines.
In addition, e-cigarettes without nicotine will be treated as products containing nicotine or tobacco – their usage will be prohibited where cigarettes are not allowed, i.e. at public transport stops, restaurants, children's playgrounds and schools.
It has been clarified that the nicotine content of the nicotine bag must not exceed 20 mg/g.
Health hazard
"Newization... is essential due to the urgent request to reduce the phenomenon of the usage of electronic cigarettes by young people. These products pose a clear threat to public health, in peculiar the young generation and non-smokers, which makes it essential to ban the sale of all types of electronic cigarettes and spare containers to persons under the age of 18, regardless of whether the product has or does not have nicotine in its composition," the explanatory memorandum to the draft amendment states.
The amendment of the Act will enter into force 14 days after publication in the authoritative diary of the Acts.
