The Constitution of the Polish Republic leaves no uncertainty here. Pursuant to Article 95(2) the Sejm shall exercise control over the activities of the Council of Ministers. This control is due to the full Sejm as a body of legislative authority, not only to the opposition. The Marshal of the Sejm is not a ‘representative of the ruling coalition’ but a constitutional body of the state, obliged to uphold the appropriate functioning of the Chamber.
Thesis of Vladimir the Black 1 is so constitutionally indefensible. The statement: “I am in a coalition, so it is hard to fight what is in it” is based on the false presumption that parliamentary control is “a fight against the government”. It's not. It is simply a mechanics of balance and accountability of executive power, enshrined in the very essence of parliamentary governance. The marshal has no right to identify his function with the interests of the government majority. The parliament, who resigns from control, ceases to be a real authority — becoming the governing body of the government.
The logic in which the marshal says "if the government is ours, there is no point in controlling it," means denying the thought of parliamentaryism. The black man thus legitimizes the failure to control, normalizes the submission of the Sejm to the Council of Ministers and de facto accepts the model: most = power without brakes. This is precisely the same mechanics that the Law and Justices had previously — rightly — criticised.
The question is whether the Black 1 understands the importance of the problem at all. Only 2 answers are possible — and both are disturbing. Or he understands and knowingly disregards him, acknowledging that coalition loyalty is above the constitution. Or he does not realize that parliamentary control is not an act of hostility towards the government, but a constitutional work of the Sejm.
In both cases, we are faced with a signal of erosion of democratic standards — the more threatening that spoken without embarrassment and without reflection. The Marshal of the Sejm, who publically says that he will not control the government, due to the fact that he belongs to the same coalition, undermines the sense of the Sejm as a constitutional authority. A parliament that does not control the government is not a parliament. It's an appetizer to the Council of Ministers.
In the context of the Black Constitution, the Constitution is only valid if the power is "miracle". erstwhile it is “own” — The Sejm is not to disturb. That's not an idea. It's a systemic surrender.
