Andrzej Duda in his last days as a presidential throne has signed an amendment to the Act on the Military Property Agency (AMW), which allows the free transfer or disposal of military equipment to another states' armed forces. The change is expected to improve the support of allies and increase the efficiency of actions for the safety of Poland. New powers of the Military Property Agency

Tuesday, 29 April 2025.President Duda signed Act of 4 April 2025 amending the Military Property Agency Act. The amendment, voted in the Parliament on 4 April and unanimously adopted by the legislature on 23 April, introduces crucial changes in the functioning of the AMW.

As highlighted in the President's Chancellery:

"The aim of the Act is to enable the Military Property Agency to execute its tasks for the defence and safety of the State more effectively".

What's changing?

So far Minister for Defence may have transferred military equipment to another countries without AMW, but only on the basis of a resolution of the Council of Ministers. fresh provisions empower Military Property Agency to manage this process independently.

Amendment introduces two main changes:

  1. Extension of AMW allowances – The Agency will be able to manage a wider scope of State Treasury assets, including dual-use equipment (military and civil) and weapons.
  2. Eliminating conflicts of competence – Problems of cooperation between AMW and military units have been solved, especially in the context of the organisation of events promoting the Armed Forces of Poland, specified as International AIR SHOW.

What will the transfer of equipment look like?

AMW can free of charge transfer or sale military equipment to another countries. The value of the transferred property shall be determined by:

  • market value,
  • degree of physical consumption,
  • Technological progress.

If the equipment is sold, the price may include:

  • costs incurred by AMW,
  • taxes,
  • research and improvement expenditure.

The final valuation decision will be taken in agreement with the MON or the Ministry of abroad Affairs.
